Walmart Crime Report October 2019

Walmart had at least thirteen shootings on the premises, or one might be just beyond the parking lot, killing at least five people, and injuring several more. (This was initially reported with only twelve shootings; however, one more at Sam's Club has been added bringing the total to thirteen, counting a shooting of a dog off the premises that resulted from a swatting incident described below it's fourteen.) They also had at least three more related to Walmart including a shoplifting incident where the suspect allegedly called 911 to report a man with a gun at another location where police shot a dog, and arrested two people on outstanding warrants even though the report turned out to be false and they suspect it was a distraction so the shoplifter could get away.

There were two more shooting incidents where suspects threatened to shoot up Walmart or kill someone there; one that led to a police stand-off before the suspect could get to an unnamed Walmart the other involved a phone call to corporate office where the person taking the call reported hearing shots during it, and suspect admitted the shootings. Three of the fatal shootings were by police, including one of a murder suspect, unrelated to Walmart, and one was a suicide. several of them were related to domestic disputes or robberies.

To get a monthly Walmart shooting count I usually include all the ones that take place on the premises or as a result of crime that began at the store, this would include twelve, on the premises this month and one that involved the police shooting of a dog as a result of the alleged false report but not the two angry people threatening to shoot it up without making it there, bringing the total for this month to fourteen. This makes it one hundred and eighteen for the year with two months to go. This is tied with the second highest for a year and only five below the record which is one hundred and twenty one, virtually guaranteeing they'll set a new record by end of November with the worst month for shootings, most of the time to go. Since I show articles to each shooting anyone that wants to check the facts can apply their own criteria.

There was another shooting that actually took place last month, but wasn't reported for a few weeks, which is happening more often than it used to, perhaps in some cases, they just omit references to Walmart so it doesn't turn up in searches, which might be part of effort to downplay their high crime problems. Hard evidence of this conclusion is limited, but there's plenty of circumstantial evidence.

Walmart also had over a dozen other gun related crimes including several armed robberies and threats to shoot the store up which weren't carried out, an attempted carjacking, and one that turned out to be a BB gun from a disgruntled customer that just said he wanted to return it, although employees said otherwise. One of these armed robberies lead to a police chase, crashing into both the deputy and another driver killing that person as well. There was one other death as a result of an accident and a body found in NJ parking lot, with a total death toll of at least eight.

The police shot another innocent man with a stun gun in Georgia, which is the same state they reported last month that a previous two hour stand off on the highway with another suspected shoplifter also turned out to be the wrong guy, in both cases they were still charged with obstructing justice of failure to obey a police officers, even though they had no way of knowing why they were arbitrarily being accused of something they didn't do, or even knew why they were being targeted by police. Both cases were also minorities.

Another police officer in Arizona was arrested on charges of shoplifting, which they're far more likely to be charged with than police misconduct or excessive force. Abuse the public, and there's little or no accountability but steal from Walmart or another oligarch and they're quickly charged.

Police were slow to investigate an alleged assault that took place five months ago, and is only being re-investigated within the past few weeks. However, they often investigate petty thefts like taking handful of snacks without paying for them, if loss prevention finds out about it by reviewing tapes, which means we often have to spend more on criminal charges then the cost of the products, even while Walmart is suppressing wages with the help of politicians they donate campaign money to.

This might be why most people consider this a rigged economy.

A Delaware man allegedly arbitrarily began choking a cashier without provocation in Florida. This adds to an enormous amount of evidence that while the people in the corporate office are taking the vast majority of the profits the employees that have their wages suppressed are the ones taking all the risks.

Of course they don't donate to campaigns, not that that has anything to do with it.

They reported a scam where someone is allegedly trying to steal from OTHER CUSTOMERS, not Walmart by scanning in a gift card at the self-checkout then walking out without paying for it. They claim he's trying to trick the next person to use the self-checkout into paying for it, instead of saying that Walmart checkout system is enabling them and that Walmart should be the ones liable not the next customer! They're doing a similar thing with truck drivers in Kentucky where they have small signs saying there's no parking and when Truck drivers, don't notice them they get booted and charged hundreds of dollars to have them removed by a for-profit private contractor hired by Walmart. when local farmers started warning truckers instead of posting it with bigger signs they tried to intimidate the farmers.

They also had at least four kidnappings or attempted kidnappings, mostly clustered in the last couple days of the month with one of them six days earlier. This is probably only slightly above average for the month but well above average for the last weekend.

In addition to the two fatal crashes, Walmart also had close to a dozen or more crashes, chases, hit and runs, or automobile fires. Many of these were major crashes with serious injuries. Several of them were following shoplifting's or robberies.

One of those crashes was a police officer that was responding o a call about an knife attack at Walmart, although the suspect wasn't in the crash; this was one of at least half a dozen knife related crimes with most involving threats or slashing that din't make contact, but at least one included a stabbing.

Walmart also had at least half a dozen fires mostly arson, including one that was intended to distract from a shoplifting, which almost never works, although it's starting to happen almost every month now. Another person was sentenced to fifteen years in jail last month for starting a fire last year so he could steal beer. They usually also charge restitution, which Walmart is constantly pushing, but even if they awarded that it comes to $1.2 million in this case so the purpose for this wouldn't be to get the money since it would never be paid but to ensure that he never has any money legally again.

This is supposedly as a deterrent, although it's only applied to poor people from their crimes not to wealthy well-connected people involved in white collar crimes. If the goal was to minimize future crimes they would think it through more carefully often trying to eliminate causes of crime like a rigged economy or lack of reasonable employment opportunities; but of course the goal is to create a government b=y the corporations and for the corporations.

There were dozens if not hundreds of other crimes including many assaults, shoplifting, purse snatching and much more; as usual some of the people most likely to be attacked are often employees or police responding to their massive shoplifting problem. It doesn't take a genius to realize that their store design, corner cutting, and union busting policies are major contributing factors to their high crime problems; however the only thing the corporate office seems to care about is maximizing profits regardless of how much danger their policies seem to put both customers & workers. Politicians and media seems to be more concerned with collecting campaign donations or advertising dollars than trying to draw attention to solutions that would work.

Walmart always has at least several recalls or reports of problems with their merchandise every month, most of which are't reported widely; but this month seems to be even higher than usual with close to a dozen high profile articles. They had recalls for 6,000 pounds of sausage patties, exercise equipment, J&J baby powder and a couple recalls of Zantac. They also had hats that got the local teams name wrong, complaints about tampered pills, ground beef that had glass in it, and and a pair of child's sneakers that supposedly had a razor blade in it.

This is simply not a new problem and they go through many of the same recalls over an over again, but then cut corners again leading to more problems. the same corner cutting to increase profits causing their high crime problems is causing many other problems as well.

Now Walmart want to take their practices into the health care industry, and they have a lot of support on Wall Street and in the media to help with their propaganda. They're opening a growing number of clinics and creating alliances with major health care companies consolidating into Oligarchies with little accountability, like the retail sector.

In some cases this is combined with their efforts to influence the education field as well which is a disaster; for the past year or so they've been promising what they call a college education for a dollar a day; now they're including medical training in this program. But when they don't tell you at first is that it's an online college and that existing ones like K-12 that have been around longer have proven to be a disaster, with much less personal contact or help with lessons. This may not be much, if any better than research you can do online for free, which can be very effective for self-motivated people but most people need more advice than that. Those that don't will see through this scam.

Walmart is also involved in a larger number of lawsuits than usual, which is a lot. They've lost a few and even under Trump the EEOC is filing some suits against them. there are still many judges that are friendly to their oppressive policies but others are overturning some of their rulings, which're so outrageous. the constant revolving door with other corporations often that they're supposedly competing against continues to turn every month almost without exception with half a dozen executives moving to or from Walmart.

They're becoming a leader in high tech thanks to alliances with many advanced technology corporations or buying them up with a growing number of patents for Drones artificial intelligence, robots, and data scientists often to spy on customers and workers. there's little or no input from privacy rights advocates on these policies nor is the public being told about it except in a large number of articles that are scattered in low profile locations most people don't read so they won't be able to figure out how it impacts them.

They have media outlets trying to portray them the victim of union bullying despite fact that their practices are legendary suppressing workers rights. they've been caught charging double or more for bottle deposits in California. they've been censoring their own ads, to cover up guns while ignoring other contributing causes of violence. And they're using market power to extract fees from sellers using their online store, although Amazon is even worse about this. There's little or no doubt that the free enterprise system was eliminated years if not decades ago replaced with an oligarchy system.

One of the most blatant signs that the oligarchy system is breaking down is an absurd shortage on dish soap that they supposedly have according to signs they've been putting in their aisles, although most reports say that there's plenty of soap on the shelves. As absurd as it sounds I'm not ruling out possibility they might be trying to encourage people to buy soap up as part of an experiment for marketing purposes.

They had at least two women in two different states bite police officers while they were trying to arrest them, and another sixty year-old women was caught bottomless in her care with legs in the air, well masturbating. she didn't bite the police that I know of but did resist.

Another man high on PCP broke into a closed Walmart to use hair clippers to carve a $2 dollar pumpkin before being arrest.

And supposedly "voodoo" made a Texas man shoplift at Walmart.

This isn't unprecedented; they've had people going on rampages because they were told to by a "Hookah smoking rabbit" or becasue tehy were being chased by "zombies" during the "Apocalypse" and many more strange things.

I didn't have to make these things up.

Strange things happen at Walmart!

In 2006 Wake Up Walmart did a study, "Is Walmart Safe?" based on incidents in 2004, (PDF) about crime at Walmart which showed that it increased when Walmarts opened up and that crime was higher at Walmart than at other retailers. Since then Walmart Shootings began compiling a list of gun related incidents at Walmart and demonstrated that they have a large number of them, including on average more than one shooting per week somewhere in the country; now after counting them for several years that average is over two per week. In January of 2014 another study, "Rolling Back Prices and Raising Crime Rates?" provided additional statistical research indicating that Walmart might be contributing to higher crime rates or at least a slowing of the decline in crime. The study found that. “on average, communities with Walmarts had 17 more property crimes and two more violent crimes per 10,000 people than those communities without Walmarts.” I reviewed this more in Walmart’s crime problem, Rolling Back Safety more than prices? where I explained that although this study is helpful they could have done better with additional data that is available and I reviewed some of that. I also added my own review about why I think that Walmart policies have been contributing to higher crime in a previous blog, Walmart high crime rate continues un-investigaterd and have provided additional information under the author tag Walmart Crime Watch.

Stacy Mitchell has also compiled a list of other studies about Walmart and how they impact society, Key Studies on Big-Box Retail & Independent Business. To the best of my knowledge Walmart has done as little as they seem to get away with, often relying on rhetoric that isn't backed up with action, when it comes to addressing any of their critics concerns, including crime. One of the responses they’ve come up with is what they call "Restorative Justice" which gives first time shoplifters a chance to avoid being arrested or any criminal record if they take an on line course which costs $400 up front or $500 in payments, plus perhaps, reparations. This has been part of the privatization process and often denies suspects of the due process or access to a lawyer, perhaps even intimidating and extorting from some people that might not even be guilty. Walmart seems to be trying to find a way to turn crime into a profit making situation instead of looking for the most effective ways to reduce it. Making Change at Walmart is asking If you or someone you know has gone through @Walmart's "Restorative Justice" program for first-time suspected shoplifters, send us a DM. 03/30/2017 to ensure that it isn’t doing more harm than good. I did my own review of this program as well at Walmart’s “Restorative Justice” Endangers Public Without Reducing Crime. The following are a list of incidents that occurred in October 2019. According to the "Is Walmart Safe?" the average store in their sampling had 250 incidents per year, indicating that these are only a fraction of the crime reports at Walmart, and presumably, the ones most likely to make the news on the internet nationwide. This isn't statistically representative, as the 2006 or the "Rolling Back Prices and Raising Crime Rates?" study or some of the studies cited by Stacy Mitchell; but it does provide some additional information that may help recognize how many problems there are at Walmart.

After argument at Mount Airy Md. Walmart, man charged with assaulting woman 10/01/2019

A man allegedly dragged a woman out of a vehicle in the parking lot of the Mount Airy Walmart, then punched himself in the face and told police that she struck him, police say.

Thomas J. Caron, 32, of the 9200 block of Gue Road in Damascus, was charged with second-degree assault and released on $5,000 bail Sunday, online court records show.

According to the statement of probable cause, Caron told Mount Airy police he argued with a woman while they were sitting in a truck in the Walmart parking lot at 209 E Ridgeville Blvd. and she hit him with the back of her hand Saturday at about 6:54 p.m. Caron said he took the woman’s cellphone and money, went into the Walmart, and when he returned they argued and he called 911, the statement reads. Police noticed redness and slight bruising on Caron’s right eye and right side of his face, according to the statement.

The woman had a different story to tell. According to her, when Caron returned to the vehicle he grabbed her arm and pulled her out of the truck, cutting her foot, the statement reads. The woman’s arm had “white marks” from where she was allegedly grabbed and there was a small cut bleeding on her right foot, according to the statement.

A witness said he heard loud yelling coming from the vehicle and heard Caron say he was going to hit himself and call the cops on the woman, then Caron proceeded to hit himself in the face, the statement reads. The woman came to the witness for help, according to the statement. Complete article

Ask An Expert: Can Walmart Win With Stand-Alone Clinics? 10/01/2019

Walmart recently opened its first-ever stand-alone health center, offering everything from primary care to EKGs to counseling to dental services. The Dallas, Georgia test site is Walmart’s boldest healthcare move yet. And it comes as rivals CVS, Walgreens, Target and Amazon are all muscling into medicine as well.

But how open are Americans to healthcare delivered at the end of the chewing-gum aisle? Marketing Daily asked Ateev Mehrotra, MD, a policy analyst at Rand Corp. and associate professor of health care policy at Harvard Medical School, to weigh in.

Marketing Daily: Retailers have been running health clinics for years, yet they’ve never really taken off. What’s the growth potential?

Ateev Mehrotra: In one study of a big national insurer, the numbers of visits to retail clinics went from about 11 visits per thousand in 2008 to about 38 visits per thousand in 2015, a 250% increase over eight years. So it may be growing rapidly, but it’s off a low base, and 38 per thousand still isn’t that many. Complete article

Walmart Suspends Sales of Zantac as Tainted-Pill Worries Grow 10/02/2019

Walmart Inc. plans to suspend the sale of all over-the-counter versions of Zantac, becoming the latest retailer to take such a step as concern over the presence of cancer-causing contaminants in the stomach drug increases.

The world's largest retailer said in a statement on Wednesday that it made the move after closely monitoring a recent alert from the U.S. Food and Drug Administration that the products, which are also sold under the generic name ranitidine, may contain low levels of the potential human carcinogen NDMA.

A recent series of drug recalls has raised concerns about the safety and integrity of the U.S. drug-supply chain and the capacity of regulators to adequately police a sprawling global network of pharmaceutical suppliers. NDMA was previously detected in generic blood-pressure pills, sparking a recall of millions of pills in about 30 countries.

Walmart said patients could return the drugs, including medicine sold under the Equate and Member's Mark brands, to its Walmart and Sam's Club stores for a refund. Walmart has pharmacies in thousands of its U.S. stores. The FDA has advised consumers who take ranitidine medications for heartburn and other stomach ailments to consider alternative therapies while the agency investigates the contamination.

Walmart to test new health care services for workers 10/03/2019

NEW YORK — Walmart is rolling out a health care pilot program for its employees that will come up with a curated list of high quality providers but offer fewer choices than under the current plan.

Through the program, Walmart will help employees connect with local doctors in areas like primary care, cardiology and obstetrics. It is working with Nashville-based data analytics company Embold Health, which will cull through vast amounts of data from public and private insurance plans to come up with recommended providers based on effectiveness and cost-efficiency. Walmart will in turn use that data to curate a list for employees.

“It’s a thoughtful approach to a goal of better health and better health care,” said Adam Stavisky, senior vice president US benefits, Walmart during a media call on Wednesday. ......

The downside of the program is that employees will be faced with fewer doctor choices. Walmart says that workers can use doctors who are not on the company’s curated list but it will cost more. .....

That can mean offering coverage that steers patients away from expensive hospitals for routine imaging exams or pushes them toward doctors that are considered higher quality. .......

As part of the pilot program, Walmart is expanding its telehealth program where workers get diagnosed with a live doctor via video. Currently, Walmart offers basic telehealth to nearly everyone on its medical plans for minor medical issues like a sore throat. However, as of Jan. 1, workers in Colorado, Minnesota and Wisconsin can opt to access a personal online doctor and a team to manage chronic conditions like diabetes as well as preventative care. Springfield K9 OK after struggle to arrest man at Oregon Walmart 10/03/2019

A Springfield police K9 is OK after it was hit several times in the head by a man involved in a standoff with police Wednesday morning outside of the Walmart in Springfield.

The man, 19, was eventually taken into custody on suspicion of resisting arrest, seven counts of reckless endangering, delivery and possession of heroin and methamphetamine, unlawful possession of a firearm, obliteration of identification number on a firearm, reckless driving, interfering with a law enforcement animal and interfering with police. Formal charges are anticipated Thursday afternoon.

The man, who was reported as a missing person in Eugene, reportedly suicidal and in possession of a handgun, told Springfield police officers that he hoped his actions would lead police to shoot him.

The incident began just after 3 a.m. Wednesday in the Walmart parking lot on Olympic Street. He also had a warrant out for his arrest from Eugene Municipal Court for failing to appear on a disorderly conduct charge.

Officers found the man in his car and allegedly refused to exit, despite officers telling him to exit and that there was a warrant for his arrest.

According to police, offices parked their patrol vehicles in front and behind the car to prevent him from driving away. After 20 minutes, he agreed to exit, but instead put the car in gear, ramming a patrol vehicle parked in front of him and then the patrol vehicle behind him, police said.

An officer broke out the man's driver's side window and K9 Gryff was used to take the man into custody. The man allegedly struck the dog several times in the head. Officers got the man into custody after a brief struggle. Springfield police said Gryff the K9 is OK.

Springfield police located a loaded handgun, a digital scale, and several packages of heroin and meth in the man's possession. He was taken to the hospital for treatment of minor injuries and was then booked into the Lane County Jail. Complete article

Filing: Walmart not complying in suit 10/08/2019

Walmart Inc. should be sanctioned and held in contempt for failing to give the Equal Employment Opportunity Commission "crucial" information in a lawsuit claiming the retailer discriminated against pregnant women at a Wisconsin distribution center, the agency said in a recent federal court filing.

The EEOC document, filed Thursday in U.S. District Court for the Western District of Wisconsin, says Walmart failed to comply with a June 13 court order regarding discovery. Specifically, the Bentonville-based retailer only provided some of the requested information about nonpregnant employees who received "light-duty" assignments because of work-related injuries, the filing states.

"After engaging in lengthy delay tactics, Defendant has recently informed EEOC that it will not provide a complete response" to the agency's nine-part question concerning light-duty accommodations for injured employees, according to the filing. Walmart has provided the requested information on all but two parts of the question, the document states: the medical restrictions of each employee who received light duty, and the type of light-duty assignment each was given.

Walmart spokesman Randy Hargrove said Monday that the EEOC's claims "do not reflect the high ethical standards and careful and reasonable approach we take in litigation, including this case. We take our discovery obligations seriously, and believe we have complied with the Court's rulings related to document disclosure." Complete article

Man who triggered SWAT situation threatened to kill girlfriend, shoot up a Ga. Walmart: Officials 10/08/2019 (Shooting not at Walmart)

CLAYTON COUNTY, Ga. — A wanted man is in custody after a massive standoff shut down a busy interstate for hours.

But before that, authorities said that suspect, Timothy James O'Neil, threatened his girlfriend's life, hundreds of miles away in Nebraska.

U.S. Marshals said O'Neil and his girlfriend were involved in some sort of argument there before he got in his car and drove to the Atlanta area where he allegedly said he was "taking his gun to shoot up a Walmart." Authorities aren't sure which store he was referring to.

Marshals got wind that his journey took him to his sister's Bimini Road home in Forest Park, just off I-75, so they followed him to try and serve a warrant for his arrest for allegedly making terroristic threats.

Instead, O'Neil ended up in a standoff with officers for hours after firing off 10 rounds at Marshals. No one was hit. Complete article

Is Walmart Setting Its Sights on the Healthcare Market? 10/08/2019

Like rival Amazon, the retail giant is testing some employee programs that could someday evolve into offerings for the public.

Amazon (NASDAQ:AMZN) dipped another toe into the healthcare business last month, debuting a program for its employees called Amazon Care. The company hasn't spoken of any plans to expand it to the consumer market yet -- indeed, so far, only its Seattle employees and their families are eligible to sign up for the pilot program, which it describes as "a mobile application that allows you to access virtual and in-person healthcare service."

Nor it is part of Haven, Amazon's healthcare joint venture with Berkshire Hathaway and JPMorgan Chase. However, it's logical to assume that if the program proves successful within the company's walls, it will eventually be offered to the public.

Now, Walmart (NYSE:WMT) is following its retail rival into the healthcare market -- in a similarly small fashion -- by testing out some new healthcare options with some of its employees. It's a first step toward revamping its healthcare benefits and may eventually lead to a day when Walmart, too, connects its customers to the medical system. Complete article

Walmart has 1,500 data scientists and is hiring more amid a push to adopt artificial intelligence. The retailer's chief data officer recently shared the 3 questions that guide all its AI projects. 10/0/2019

Walmart is leading retailers in adopting artificial intelligence and machine learning, but the world's largest retailer still runs into cultural issues that undermine the push to implement the advanced technology.

The company currently has roughly 1,500 data scientists, according to chief data officer Bill Groves, and is hiring more, including a role to develop voice-activated shopping applications.

Walmart has three core questions that guide all of its AI and machine-learning projects. If the answer to any of them is "no" then the initiative is shelved immediately.

Walmart is a leader in the push to adopt artificial intelligence and machine learning. Still, the world's largest retailer runs into many of the problems other organizations experience when pursuing the advanced technology.

The company currently employs roughly 1,500 data scientists and 50,000 software engineers throughout the enterprise, according to chief data officer Bill Groves, who directly oversees a smaller staff of 100 tech workers. A Walmart spokesperson did not respond to a request to confirm those numbers.

Those employees help support the over 100,000 different machine learning or AI-based projects the organization currently has in production. Among the applications that Walmart is currently rolling-out are AI-powered cameras to monitor for theft. Complete article

Walmart Adds Kidney Transplants At Mayo To Centers Of Excellence Program 10/10/2019

Walmart is adding kidney transplants to the list of specialized medical procedures it will cover for its workers under its now 22-year-old Centers of Excellence Program for organ transplantation.

The world’s largest retailer in 1997 began its Centers of Excellence program as a way to get organ transplants to workers in need. In a conference call Wednesday with employers put on by the Catalyst for Payment Reform, Lisa Woods, Walmart’s senior director of U.S. healthcare, said centers of excellence would be performing kidney transplants as a covered benefit starting in 2020. The transplant locations are Mayo Clinic sites in Rochester, Minn.; Phoenix, Ariz. and Jacksonville, Fla. where Walmart already sends patients for other transplant procedures and certain other treatments in Walmart’s broader Centers of Excellence program.

Catalyst for Payment Reform is a nonprofit working with employers and other purchasers of medical care to coax the U.S. healthcare system into offering more value for the dollars they are spending. Walmart was discussing its various healthcare programs it is launching next year for its employees and large employers are watching these efforts closely, those on the call said. Complete article

Appeals Court Vacates Order Requiring Worker To Pay Costs to Walmart After Losing Age Discrimination Case 10/09/2019

A federal appeals court this week vacated an order requiring a former Walmart worker who lost his age discrimination lawsuit against the corporation to pay a portion of Walmart’s costs.

U.S. District Judge R. Gary Klausner had ordered Warren Mauran, who sued Walmart for age discrimination after he was fired, to pay Walmart a total of $6,012.80 in costs.

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit based in San Francisco, CA, voided the charge in a split 2-to-1 decision. The majority ruled that Klausner abused its discretion when it granted Walmart’s application for costs as the prevailing party in the case.

At the time of his termination, Mauran worked at a Pasadena area Walmart store earning $11.50 an hour. Complete article

Walmart filings seek patents for high-rise drone delivery ideas 10/10/2019

In the race to offer customers the fastest delivery of online orders, many retailers are exploring the use of drones to deliver merchandise. One of the challenges they face is finding a safe and simple way to drop off the packages at their destination, especially in crowded urban areas. Walmart Inc. has filed two patent applications for delivery systems that aim to solve this problem. Both are designs for a drone system to make deliveries to high-rise and medium-rise apartment buildings or offices.

Perhaps the simpler of the two is a window unit for receiving packages from an “unmanned aerial vehicle,” as drones are called in the sphere of autonomous delivery. According to the patent application, it consists of a frame attached to a building wall and window ledge, with a net inside the frame. The net receives the package, and the customer opens the window to retrieve it. Complete article

Union fails again in bid to bully Walmart 10/10/2019

News, $5.2 million ruling issued against Beloit Wisc. Walmart 10/11/2019

MADISON - A jury has awarded $5.2 million in damages to a long-time Beloit Walmart employee who claimed he was discriminated against because of his disabilities.

The U.S. Equal Employment Opportunity Commission (EEOC) said the ruling was issued in federal court in Madison on Thursday on the discrimination lawsuit filed in September of 2017.

The lawsuit claimed Walmart violated federal law when it refused to accommodate the disabilities of Paul Reina, who has a developmental disability, is deaf and visually impaired. He had worked for 16 years for the Beloit Walmart and was a cart pusher.

The lawsuit claimed, shortly after a new store manager started working at the Beloit Walmart, Reina was suspended and he was told to resubmit medical paperwork in order to keep his accommodations. Prior to the suspension, the Reina performed his job with assistance from a job coach provided by public funding. Complete article

Will Walmart’s Health Care Gamble Pay Off? 10/15/2019

Pushing deeper into the high-risk business of health services, Walmart has opened its first standalone primary care clinic in suburban Atlanta. Walmart Health, which has a separate entrance adjacent to the Dallas, Georgia, supercenter, offers what the company describes as transparent pricing for an array of services including dental, lab tests, X-rays, hearing, optical and mental health counseling.

Walmart already operates 19 clinics across Georgia, Texas and South Carolina that are more limited in scope, but the pilot Walmart Health signals a bigger commitment by the world’s largest retailer to capture a share of the $1.3 trillion health care industry. Walmart runs one of the largest pharmacy chains in America, and health and wellness accounted for 9%, or $36 billion, of sales for fiscal year 2018.

“We are creating a super center for basic health services,” Sean Slovenski, senior vice president and president of Walmart Health and Wellness, told Forbes. He said the clinic was part of a “serious” strategy and “not a dabble.” Complete article

Walmart subsidizing some vendors in price war with Amazon 10/14/2019

Hold on to your smartphone — the holiday price wars between Walmart and Amazon.com are heating up.

Walmart, the world’s largest retailer, has introduced a program to temporarily lower the price consumers pay for some items on its marketplace site, where third-party vendors pay Walmart a fee to list their goods. The merchants selling on the site, however, will still be paid the same amount that was listed before the cuts, with Walmart subsidizing the difference, according to a description of the plan obtained by Bloomberg that was confirmed by a Walmart spokeswoman. The price reductions won’t affect shipping fees.

The move appears to be a response to a program Amazon rolled out over the summer where the e-commerce giant has full control to set prices of third-party products sold on its marketplace — in return for a minimum payout. Amazon has also come under scrutiny for increasingly leaning on vendors to ensure that their products aren’t offered for a lower price on Walmart.com or any other rival website. Complete article

No threat at Saginaw Mich.-area Walmart after rumors of gunman spread on social media 10/16/2019

SAGINAW, MI — Police responded to an altercation between a man and a woman at a Walmart store in Saginaw County Wednesday morning, Oct. 16, prompting unfounded social media rumors of a possible gunman or active-shooter situation.

Clear Lake Tx. man's pet parrot stolen from Walmart parking lot 10/16/2019

HOUSTON, Texas (KTRK) -- Keith Wirsing has had his double yellow-headed amazon parrot named Verdi for nearly 40 years.

"He's not just a pet, he's my best friend," said Wirsing.

Wirsing was at Walmart on El Dorado on Sunday, returning something and brought Verdi along for the trip. He left the parrot in his running car with AC on while he went inside, but when came back outside, Verdi was gone.

Wirsing said, "As soon as I saw the lights weren't on, I saw the engine wasn't running, I looked in and saw Verdi wasn't there. I panicked and started looking through the van, hoping that, you know, he had just climbed down or something."

Wirsing called Houston police. He believes whoever took the bird knows of Verdi or knows something about birds.

"Not many people would risk reaching in and grabbing an unknown bird -- not a bird that size," said Wirsing.

He says he brings the bird everywhere with him.

He added, "We've been through a lot in 37 years and he's the only one that's been there." Complete article

The pockets of America where Walmart is king 10/16/2019

The cities and towns where Walmart gobbles up more than half of all grocery sales are concentrated in the South and the middle of the country, illustrating a broader division in U.S. retail.

Why it matters: Retail has become one of the forces driving American inequality. While some cities build glitzy, revamped main streets and get same-day shipping, others have few options beyond Walmart super-centers and dollar stores.

By the numbers:

* Walmart owns 50% or more of grocery sales in 203 U.S. markets, per an analysis by the Institute for Local Self-Reliance, a nonprofit research and advocacy group that opposes concentrated economic power.

* In 38 of those markets, Walmart has 70% or more of the grocery sales.

* And in some places, the retail giant has virtually wiped out all other competition. Walmart owns 95% of the market in Portales, New Mexico; 95% in Atchison, Kansas; and 90% in Guymon, Oklahoma.

The bottom line: No grocer in U.S. history has ever been so dominant. Complete article

Viewpoint: Walmart's healthcare strategy is 'a little offense and a little defense' 10/16/2019

Though healthcare is not known for being particularly open to lasting change, Walmart's ongoing attempt to revolutionize care delivery with its consumer-first approach could be the one that sticks, according to Knowledge@Wharton.

In a recent podcast from the business analysis journal, Mark Pauly, PhD, a professor of healthcare management at the Philadelphia-based Wharton School of the University of Pennsylvania, and Robert Field, PhD, a professor of health management and policy at Philadelphia-based Drexel University's Dornsife School of Public Health, discussed Walmart's push into healthcare.

Dr. Field described the strategy as "a little offense and a little defense." Walmart has gone on the offensive by attempting to translate its longstanding retail dominance into the level of trust needed to be successful as a healthcare provider, and on the defensive by quickly expanding its healthcare efforts in order to stay ahead of competitors. Amazon and Walmart Reportedly May Buy FreshDirect 10/16/2019

Amazon and Walmart are reportedly considering purchasing FreshDirect, as the grocery delivery service’s largest investor, J.P. Morgan, seeks potential buyers.

According to the New York Post, the two retailers have examined the financial and performance data of FreshDirect, making it at least the third time that Amazon and Walmart have considered acquiring FreshDirect.

FreshDirect has suffered service glitches since it moved to New York City’s South Bronx from Long Island City in July of 2018. The move was expected to enable the company to add thousands of new products and accelerate its expansion into new geographies. However, since that time, the Post reports, FreshDirect has been losing customers due to late and incomplete deliveries caused by difficulties with a new technology platform for FreshDirect’s pick-and-packing functions, which didn’t work with the customer-facing software. Walmart agrees to settle lawsuit over pregnancy rules 10/17/2019

Walmart Inc. has agreed to pay $14 million to settle an Illinois class-action lawsuit by workers who said the retailer's pregnancy accommodation policies violate civil-rights laws.

Attorneys for plaintiffs Talisa Borders, Otisha Woolbright and Stacey Lewis filed a motion Tuesday seeking preliminary approval of the settlement and conditional certification of the settlement class. The proposed class consists of current and former female Walmart employees who were subject to the company's policies and practices between March 19, 2013, and March 2014. Complete article

Walmart beats age claim by demonstrating evenly applied discipline 10/16/2019

Dive Brief: * A former Walmart employee was unable to prove that he was illegally fired due to his age, the 9th U.S. Circuit Court of Appeals has ruled (Mauran v. Walmart Inc., No. 17-56494 (9th Cir. Sept. 12, 2019)).

* Although Warren Mauran established a prima facie case of age bias, Walmart offered legitimate, non-discriminatory reasons for his termination. There was evidence to support Walmart's allegation that Mauran had violated a policy, and a much younger employee had been terminated for the same behavior for which Mauran was initially "coached" but not fired.

* Because Mauran failed to present sufficient evidence to create a triable issue of pretext, the 9th U.S. Circuit Court of Appeals affirmed a district court's summary judgment for Walmart. However, the 9th Circuit vacated and remanded the district court's decision to have Mauran pay Walmart's court costs, saying "the district court failed to appreciate the potential chilling effect on future civil rights actions" or the economic disparity between the parties.

Walmart has been in the headlines a lot recently, and not all of the coverage has been positive. Earlier this month, a jury awarded a Walmart cart pusher $5.2 million following a U.S. Equal Employment Opportunity Commission (EEOC) lawsuit alleging disability discrimination. In another suit, the agency alleged Walmart violated the Americans with Disabilities Act (ADA) by refusing to allow an applicant with a disability to take a physical assessment. And earlier this year, the store settled a separate EEOC suit to settle allegations it refused to provide accommodations to deaf employees working at a Washington, D.C., store.

The company did recently emerge victorious in a gender bias class action, but the court deciding the case concluded that something was "rotten" within Walmart's corporate culture. Complete article

After failed mediation, Brunswick Me. and Walmart still at odds over how much the retail giant should pay in property taxes 10/17/2019

BRUNSWICK — After a full day of mediation Friday, Brunswick town officials and representatives from Walmart are no closer to agreeing on how much the Brunswick superstore is worth, or how much the retail giant should have to pay in property taxes.

Walmart, the world’s biggest retailer and the seventh-highest payer of property taxes in Brunswick, claims it’s being over-taxed in Brunswick, a claim repeated in communities across the state and nation. Walmart asked Brunswick to slash its taxable value for 2017 and 2018 on the grounds that the building’s $16.9 million assessed value “exceeds the property’s fair market value;” a move that, if granted, would cost Brunswick more than $236,000 in tax revenue for the two-year period. Cloutier said he anticipates Walmart will likely request an abatement for 2019/2020 as well.

In 2017, then-Brunswick Assessor Cathy Jamison denied the company’s request for an abatement. At the time, Walmart claimed the property was only worth about $10 million, citing a Walmart appraisal that Brunswick Town Attorney Stephen Langsdorf said this summer was “very, very flawed.” If granted, Walmart would pay about $184,000 in property taxes, rather than the $311,000 it paid in 2017. Diane Ravitch: Maurice Cunningham: Waltons Are Trying to Block Funding Increase for Massachusetts Schools 10/19/2019

Maurice Cunningham is the ghostbuster of Dark Money in education. He is a professor of political science at the University of Massachusetts. He is a hero of the Resistance in my forthcoming book SLAYING GOLIATH.

In this post, he details the efforts of the Walton Family of Arkansas to block the Massachusetts’ legislators who are trying to increase funding for the public schools of their state.

He writes:

The three interest groups pushing to undermine the Massachusetts senate’s education funding bill are all Walton funded, two of them essentially full-time agents of the Waltons. They have to solve a problem for the right-wing Wal-Mart heirs: not that funding public education might fail, but that it will succeed.

The Waltons, who contributed over $2 million in dark and gray money to the pro-charters side in 2016 through mechanisms set up by Democrats for Education Reform Massachusetts, would prefer to promote charter schools and charge toward a fully privatized system with employee relations mimicking those of Wal-Mart itself. But the political momentum now is all in the direction of a vast increase in public funding, and the Waltons’ best hope is to throw sand into the implementation gears. Complete article

J&J shares fell $2.40, or about 2%, to $127.50 after news of the retailers' actions Thursday.

For J&J, last week's recall was the latest setback for a company combating thousands of lawsuits claiming the talc-based powder contains the cancer-causing mineral. According to the company, the voluntary recall is limited to just one lot of 33,000 bottles of Johnson's Baby Powder produced and shipped in the U.S. last year. J&J last week called the recall a precautionary measure and maintained that its baby powder does not contain asbestos.

"[J&J] has a rigorous testing standard in place to ensure its cosmetic talc is safe and years of testing, including the FDA's own testing on prior occasions — and as recently as last month — found no asbestos," the company said in a statement. Complete article

Huge PETA Win! World’s Largest Retailer, Walmart, Ends Live Fish Sales 10/24/2019

Following a decade-long PETA effort and urging from tens of thousands of PETA supporters, Walmart is ending the sale of live fish. The move comes after scores of concerned individuals contacted PETA and have posted online disturbing reports of cruelty and neglect, describing incidents in which fish were cruelly tossed out with the trash, left to suffocate to death slowly, or flushed down toilets.

Others lingered in filthy water inside containers stacked one on top of another—along with some who were already dead—on the shelves. In thanks for Walmart’s decision to end this cruel practice, PETA is sending the company a box of vegan fish-shaped chocolates.

“Walmart’s decision will spare countless sensitive, vulnerable fish immense suffering and miserable, lonely deaths,” says PETA Executive Vice President Tracy Reiman. “Walmart has wisely stopped tormenting fish and horrifying its customers, and PETA is calling on Petco and other businesses still selling living, breathing beings as merchandise to follow suit.” Complete article

Walmart wants robots in stores. Target doesn’t 10/24/2019

Walmart and Target are taking different approaches to adding robots in stores, a split that will have an impact on the companies’ massive workforces and shape the future of automation in retail.

Both of these legacy brick-and-mortar companies are testing robots in their warehouses. Walmart, the country’s largest retailer and private employer, expects to add self-driving robots that scrub floors to 1,860 of its more-than 4,700 US stores by February. It will also add robots that scan shelf inventory at 350 stores and bots at 1,700 stores that automatically scan boxes as they come off delivery trucks and sort them by department onto conveyer belts.

Walmart’s 178,000-square-foot supercenters are expensive to operate, especially as more shoppers shift online. The company is adding robots to help it increase worker productivity and control costs. Walmart has around one million hourly workers in its stores. Complete article

Farmers to the rescue in Ky. Walmart parking lot notorious for booting truckers 10/25/2019

Numerous drivers have reported being booted with little or no warning and then being forced to pay hundreds to get the boot removed.

A group of farmers recently stepped in to help save truckers from a costly boot removal fee for parking in a Kentucky Walmart lot.

Kentucky news outlet WKYT recently shared a story about how three farmers took it upon themselves to warn truck drivers parked at the Berea, Kentucky, Walmart about a boot-happy security company called R and R Parking Management.

One of the farmers featured in the story, Chris Young, says that he stops by the Walmart frequently after work and has noticed employees with R and R Parking Management booting parked semi trucks with little or no warning.

Young says that there are signs warning about the Walmart’s truck parking policy, but that they aren’t very easy to spot.

According to the report, one night Young and the two other farmers decided to warn the truckers that they were about to be booted and eventually got into a verbal confrontation with an R and R Parking Management employee who told them to stop warning the truckers.

During the confrontation, Young told the worker “It’s common decency to say, ‘Hey, you should have read that sign. You need to move now.'”

The R and R Parking Management employee left the premises soon after.

There have been numerous news reports and social media posts about truck drivers who have been booted at the Berea parking lot in the last year. Many drivers say that they received little or no warning before waking up to a fine of up to $800 to remove the boot. Complete article

Andrew Yang warns Walmart robots will sideline workers in 'winner-take-all-economy' 10/26/2019

Democratic presidential candidate Andrew Yang sees Walmart's plan to use more robots in its stores as a symptom of a larger problem: a march toward automation with the potential to crush the U.S. labor market.

The retailer, which is the largest U.S. employer with about 1 million hourly workers, is adding automatons to buoy productivity and curb costs, according to a report from CNN. They will handle tasks such as scrubbing floors and scanning shipment boxes. Worker advocates, however, fear their responsibilities are likely to grow as they become more sophisticated.

“We are in the midst of the greatest winner-take-all economy in world history,” Yang, who has repeatedly warned of a "trickle-up" system that benefits the rich at the expense of others, told FOX Business on Friday. “This will only accelerate as artificial intelligence leaves the labs and transforms industries and companies. The best path forward is to make us all shareholders in the progress and innovation of the 21st century through a Freedom Dividend for all American adults.” Complete article

Pitt prospect Timothy Brown arrested in Florida on charges of robbery, battery and kidnapping at Fla. Walmart 10/28/2019

Palm Beach (Fla.) Gardens High School defensive tackle Timothy Brown, who verbally committed to Pitt in June, is under house arrest after he was charged with robbery, felony battery and kidnapping in connection with an incident Thursday in Lake Park, Fla.

The Palm Beach Post, citing a police report, reported four students, including Brown, jumped a man outside a Walmart Supercenter, pointed a gun in his face and threw him out of a moving SUV.

The Post reported Brown played in Palm Beach Gardens’ football game Thursday, hours after the attack is alleged to have occurred.

The unidentified 18-year-old, who had several scrapes and cuts on his arms and legs, initially refused to press charges, fearing retaliation, according to the Palm Beach County Sheriff Office’s report.

Later, he said he would cooperate but had a violent seizure and fell unconscious and was taken to St. Mary’s Medical Center in West Palm Beach, the report said.

At the hospital, the man told investigators he previously had been “jumped” by the men while leaving his ROTC program. Complete article

Woman claims mentally disabled son kidnapped from Fla. Wal-Mart and dumped at nearby eatery 10/29/2019

A 62-year-old woman claims her mentally disabled adult son was abducted from the Summerfield Wal-Mart and then kicked out of a car at a nearby fast-food restaurant.

The woman called a Marion County sheriff’s deputy for help on Monday and told him that she and her 31-year-old son were at the cash register in the store on Oct. 9 getting ready to check out. She said she was holding her son’s hand before she briefly let go and he walked over to a wall near the restrooms inside the store, located at 17961 S U.S. Hwy. 27/441.

The woman said she remained at the cash register waiting for a gift card and once she had it, she realized her son was missing. She said a Wal-Mart manager quickly locked down the store and helped her search for him.

The woman said someone then apparently called into the sheriff’s office to report her son being found at the Sonic Drive-In restaurant at 11211 SE 178th Place – right outside the boundaries of the Wal-Mart parking lot. The woman said she went to the eatery and found her son with a Sonic manager, a sheriff’s office report states.

Walmart Replaces CEO of Struggling Jetblack Shopping Service 10/29/2019

Walmart Inc. has replaced the head of Jetblack, a personal-shopping service for upscale urbanites, a widely expected move that could presage a spinoff of the unprofitable venture.

Jenny Fleiss, who has run Jetblack since its launch a year ago, is taking a new advisory role reporting to Janey Whiteside, Walmart’s chief customer officer, a spokesman said in an email. Nate Faust, a senior vice president of logistics for the company’s online arm who had been working on the Jetblack business over the past few months, will take over.

The shuffle was an open secret for weeks inside Walmart and could precede a sale or spinoff of Jetblack, which was a pet project of U.S. online chief Marc Lore and the first business to emerge from Walmart's internal incubation arm. Jetblack promised to deliver just about anything to busy city dwellers for $50 a month, but it has proved costly to operate and never expanded beyond doormen-serviced buildings in New York City. The Outer Worlds Walmart Advertisement Censors Protagonist's Gun 10/29/2019

A Walmart advertisement for The Outer Worlds was discovered to be censoring the protagonist's gun with the game's popular Moon Man helmet from the game's narrative. Walmart had previously indicated that the company would begin enacting a harsher policy in terms of advertising firearms after a mass shooting in the United States earlier this year, a move that many consumers met with criticism given the retailer's decision to continue selling actual firearms regardless.

Video game censorship is in a delicate spot at the moment, as fans are beginning to rally behind the notion that they aren't having their voices heard by publishers and retailers. The most obvious example of that recent trend comes from Blizzard's handling of the blitzchung Hearthstone incident, which saw the Chinese professional player harshly penalized for voicing his support for the protests on-going in Hong Kong. While the company later back-tracked on some of the punishment, it maintained its stance overall, leading to fans attempting to organize protests for public events. While some public events, like the Blizzard Overwatch Nintendo Switch launch event in New York, were canceled, the same won't be happening at BlizzCon 2019 - which is the site many expect will play host to the next stage in the struggle between consumers and video game publishers over censorship. Department of Justice Sues Walmart to Enforce Employment Rights of Colorado Naval Reservist 10/30/2019

DENVER – The Department of Justice filed a civil complaint today in the United States District Court for the District of Colorado on behalf of Naval Petty Officer Third Class Lindsey Hunger against Walmart Inc. The complaint alleges that Walmart violated the law when it declined to hire Hunger due to her upcoming naval reserve duties.

“The members of our Armed Forces routinely make personal sacrifices to protect our nation. The least we can do as a nation is ensure they aren’t discriminated against for making these sacrifices,” said U.S. Attorney Jason R. Dunn of the District of Colorado. “When such discrimination does occur, this office and the Department of Justice will step in to right that wrong.”

“Servicemembers risk their lives to protect all of us. They deserve our full support, and the law does not permit employers to use military service as a reason to deny service members jobs and other employment opportunities,” said Assistant Attorney General Eric Dreiband of the Civil Rights Division. “Defending service members is very important, and the U.S. Department of Justice will continue to aggressively enforce the Uniformed Services Employment and Reemployment Rights Act and other federal laws that protect service members.”

Hunger alleges that in May 2016 she applied for a summer job at Walmart while she was a member of the United States Naval Reserve. After applying online, she received a call from Walmart’s personnel coordinator for the Walmart located at 2545 Rimrock Avenue in Grand Junction, Colorado. At the end of the call, Hunger mentioned that she was required to complete a mandatory two-week annual training for her Navy Reserve duty during the summer. The Personnel Coordinator responded by telling Hunger that Walmart could not support that time off, and ended the call. Walmart never called Hunger again about her application for employment. Hunger, who was supporting two young children at the time, could not find other employment in Grand Junction during the summer and fall of 2016. Complete article

Walmart, Costco recall baby formulas because of potentially deadly bacteria 10/30/2019

The homeowner, Leo Lech, was left with a blown-out shell of a house after a suspected Walmart shoplifter, Robert Jonathan Seacat, ran into the house trying to avoid the police, reports the Washington Post:

Projectiles were still lodged in the walls. Glass and wooden paneling crumbled on the ground below the gaping holes, and inside, the family’s belongings and furniture appeared thrashed in a heap of insulation and drywall. Leo Lech, who rented the home to his son, thought it looked like al-Qaeda leader Osama bin Laden’s compound after the raid that killed him.

The June 2015 incident was long and drawn out, according to the Post, leaving the home in such disrepair it had to be condemned.
For 19 hours, the suspect holed up in a bathroom as a SWAT team fired gas munition and 40-millimeter rounds through the windows, drove an armored vehicle through the doors, tossed flash-bang grenades inside and used explosives to blow out the walls.

For his pain, the city offered a mere $5,000—less than the cost of his luxury leather sectional sofa—which would be needed to go toward temporary rental assistance and the insurance deductible. For their losses, the Lech family would receive nothing.

After Lech sued the city, a three-judge U.S. Court of Appeals panel ruled on Tuesday that the family is not entitled to any more money from the city, writing that since the police were trying to enforce the law when they destroyed the Lech home, eminent domain doesn’t apply.

The Lechs had sued under the Fifth Amendment’s Takings Clause, which guarantees citizens compensation if their property is seized by the government for public use. But the court said that Greenwood Village was acting within its “police power” when it damaged the house, which the court said doesn’t qualify as a “taking” under the Fifth Amendment. The court acknowledged that this may seem “unfair,” but when police have to protect the public, they can’t be “burdened with the condition” that they compensate whomever is damaged by their actions along the way.

Yes, wow, how dare police need to do what most every working person in America needs to do—which is compensate someone if they literally blow up their home (while on the job). Complete article

Tulltown officers were called to the Levittown Town Center around 5:30 a.m. Tuesday for a suspicious person in the area of the Home Depot. They arrived to find that a woman had used some electrical infrastructure by the Subway restaurant to gain access to the roof of the shopping center, according to court papers.
