Is the truth for sale on commercial media?

Commercial media is owned by six corporations controlling well over 90% of national media, they cover expenses by selling ads, and are owned by a fraction of one percent of the wealthiest people in the country; I don't see how there could be any doubt that money is corrupting the vast majority of the media. Wealthy people control virtually all powerful institutions, and they've demonstrated with their actions that they're not above using propaganda to indoctrinate everyone they can, if they can get away with it, to rig everything in their favor. They do this even though they already have more money and political power than they need and increased amount of money or political power will do nothing to increase their own quality of life, although it may cause a serious deterioration for society, which is already underway in many so-called "sacrifice zones," which will eventually backfire even on them.

Are they so insane that they'll distort the truth even when it comes to environmental destruction and Climate Change, which will inevitably destroy even them eventually?

The closer you look at the evidence the more obvious that it appears they've already answered with their actions, and the answer is yes!

The Republicans don't even pretend they want to solve this problem at all, often claiming that Climate Change is a hoax; even if some of the claims surrounding Climate Change are flawed, there's little doubt among credible scientists that most of it is real, and even if that weren't true, there's much more to pollution related problems than Climate Change, and the evidence is much stronger for a lot of it. The vast majority of environmental destruction is in third world countries, or in the poorest part of our country, often where minorities live, and there's overwhelming evidence to prove this, assuming the establishment is willing to look at that evidence, which they're usually not. One good source, Which Countries Destroy the Environment the Most (and Least)? 05/01/2017 says that we started using natural resources faster than the planet could produce them back in 1970, and that it's been getting steadily worse sine then; several other sources including The World Is Using Natural Resources Faster Than Ever Before 07/30/2019 claim that we used natural resources 75% faster than the planet can replenish them in 2019, and previous reports, including We’re Depleting Natural Resources Twice As Fast As Nature Can Recover. Here’s The Good News. 07/31/2018, indicate it was only 70% in 2018, which may indicate it's growing by about 5% per year, which would mean we may be using resources 90% faster than the earth can replenish them this year, although that's subject to confirmation. And yet the biggest corporations causing environmental damage are constatly coming up with propaganda to downplay their faults and promote an economic system based on constant growth selling people things they don't need including How Walmart convinced critics it can sell more stuff and save the world 10/13/2022 which is a long rambling article trying to explain how Walmart has dealt with all their critics, implying their bad reputation was behind them; yet it can't change the fact that constant growth is incompatible with reversing environmental damage, and shows some of the green-washing described by Christine MacDonald reported on in Green Inc.

Despite claims by the Democrats that they want to address this problem, like campaign promises from the squad during the 20128 campaign and President Biden's recent claims that "good environmental policies are good economic policies," which sounds very good, and it is true, but they're doing little or nothing to make the major changes that are needed to reverse this process. and there's still a massive amount of propaganda to deny Climate Change is real funded by the oil companies, even if there isn't quite as much as there used to be. Furthermore, commercial media sells and enormous amount of propaganda ads, which they often deceptively refer to as public relations ads about many other subjects giving wealthy, for profit organizations, a massive advantage over more honest grassroots organizations that aren't making a lot of money to deceive the public and pay for the ads. This includes massive amount of ads for insurance, or to prevent Medicare for All, which a large majority of the public supports, other pooled risk financial services like after market warranties, which are just as inefficient, ads about how corporations are giving benefits to their employees, often even when they have major protests or lawsuits based on labor practices, and when the benefits are a small fraction of what they pretend to offer, investment firms claiming to help the poor while rigging the economy doing far more damage than their small charity donations, and many more deceptive ads that are extremely biased, if not outright lying.

However, unlike pollution and epidemic environmental destruction including Climate Change, most of these other issues don't literally involve ecocide or destruction of the planets ability to support life. You would think that no one would be stupid enough to create a massive amount of propaganda to guarantee they can increase profits in the short term by eventually destroying the environment and everyone else, including themselves. You would be wrong. The most powerful people in the world are being led by oil and financial companies, with the help of other major Wall Street corporations, the media, and the vast majority of the political establishment to create an ideology that will eventually destroy us, although I can't be certain when, or which warnings from researchers are the most accurate.

However, although there should be no doubt that we're destroying the planet, even though, at best it could be deacades before it gets much worse for people living in wealthy areas, or we conclusively pass the point of no return, the oil companies and their Wall Street allies have been buying up propaganda, corrupting politicians and the media, and funding inaccurate science to prevent the solutions that we need, which should have started decades ago. It seems to me like there were much more of their propaganda ads about five years ago; however, I've still seen a few ads from Chevron or think tanks portraying domestic oil, like the keystone pipe line as the most effective solution to our energy problems. And even when there are ads promoting clean energy, they often exaggerate how much is being produced, and some of it may be green-washing for the oil companies; or when real environmental groups really do buy ads to protect the environment, they only have a minuscule fraction of the advertising budget. Some of this is explained in the following article from Grist, which explains when or why they increase their spending in some cases, among other things:

Big Oil spent $3.6 billion to clean up its image, and it’s working 12/24/2019

“You want to know one of the reasons we’re not acting on climate change? $3.6 billion spent on corporate propaganda might have something to do it.”

If you’ve ever seen an ad featuring ExxonMobil scientists handling beakers of green goo, the algae that will supposedly fuel the future, you’ve been the target of an oil company’s advertisement. Exxon isn’t trying to sell you a product, exactly — but it is hoping to sell you on the idea that it’s committed to a greener future.

Over the past 30 years, the world’s five biggest oil companies have forked over more than $3.6 billion for reputation-building ads like this one. “When we looked at the dollar amounts, we were sort of blown away,” said Robert Brulle, a visiting professor of environment and society at Brown University.

Promotional ad spending from Exxon, BP, Chevron, Shell and ConocoPhillips has fluctuated a lot over the years, so Brulle’s research team decided to figure out why. The results, published in the journal Climatic Change this month, suggest that oil companies pour money into promotional campaigns for two main reasons: to boost their reputation when they’re getting negative media coverage, and to influence policymakers when Congress is considering climate legislation.

Consider the Deepwater Horizon spill in 2010, when BP’s oil rig exploded, filling the Gulf of Mexico with nearly 5 billion gallons of oil. Unsurprisingly, the news coverage was not exactly favorable. BP’s spending on promotions ads jumped from just $10,000 the year before the spill to a whopping $168 million in 2010, adjusted for inflation.

“If you want to make your case in a legal court, you gotta go get a lawyer,” Brulle said. “If you want to make your case in the court of public opinion, you gotta go get a public relations agent.” Complete article

Even if the oil industry isn't spending quite as much as they did about five years ago this clearly indicates that it may only be temporary, and that if action against Climate Change is taken it could increase much more. There is still plenty of ads promoting domestic energy, which often means either the Keystone Pipeline or Fracking, among other traditional fossil fuels that are destroying the environment, which they occasionally try to claim is much cleaner that it was previously, and with supposedly progressive politicians, like John Fetterman, who now says he supports fracking they may not feel as much need to spend as much on propaganda to convince us that Fracking is safe, for now. Furthermore, traditional oil companies have often tried to convince us they're promoting more clean energy like wind or solar often greatly over estimate what they're doing for clean energy as part of a green-washing propaganda campaign designed to clean up their reputations more than the environment, one of the greatest examples of this is British Petroleum's efforts to convince consumers that BP now stands for "Beyond Petroleum," even though they're only providing a token amount of investment in clean energy with much more spent on propaganda.

These propaganda ads obviously have no credibility, although many complacent people that don't things through will fall for it if it's repeated often enough; more important, the commercial media that makes massive amounts of money selling deceptive propaganda ads also has serious credibility, especially when they don't provide nearly as much coverage on issues exposing their own advertisers. This isn't limited to ads about environmental destruction or energy; it also includes ads about insurance or aftermarket warranties, which obviously make any industry involving pooled risk less efficient, since the more they spend on ads the less they have available for legitimate claims, worker relations, since, once again the more they spend on propaganda the less they can spend on employees safety or other employment issues, health care, or anything else! When it comes to the environment organizations like Grist and a few more I listed below are far more credible than traditional media, although caution should be taken to ensure that we don't rely on organizations that might gradually turn into green-washing organizations for Wall Street as Christine C. MacDonald pointed out in her book Green, Inc.: An Environmental Insider Reveals How a Good Cause Has Gone Bad 2008. This should be kept in mind when searching for good environmental news outlets, for example, when I Googled some of the best sources, one of the news sources recommended was Bloomberg Environmental, which I would be highly skeptical of, considering their ties to Wall Street corporations profiting off the destruction of the environment, and some news outlets might not be quite so obvious.

Even though some of the grassroots environmental organizations are among the best, there are also some satirical sites that are far better than traditional news, assuming you use reasonable discretion, which isn't always that hard, including The Yes Men on Climate Change which creates a lot of spoofs, some that make very good points and even exposes corporate hypocrisy. One excellent example of this is an article about how "BlackRock Does the Right Thing" 01/16/2019 which turns out to be a satire based on a BlackRock Hoax letter addressed to CEOs 01/16/2019 which actually gives very good advice, and if you think about it, in the long run it's also good economic advice, although they didn't see it that way. The following is an excerpt from the hoax letter, which they were forced to deny:
... But we find that the biggest contributor to uncertainty is also the greatest threat to the long-term stability of our economy and our investors’ assets: climate change. Companies must address climate risk factors or fail in their fiduciary duty.

.... With our partners in the Investment Stewardship Group, we criticized the Trump administration for pulling the US out of the Paris Agreement to combat climate change. We see the Paris Agreement as an important framework for long-term sustainability. Despite denouncing the short-term thinking that pervades management, BlackRock’s voting record has not aligned sufficiently with our own ideals. That’s going to change. Moving forward, we will demand more accountability. We will require all companies we hold stakes in to align their business models with the goals of the Paris Agreement. We have made strides in this direction, but the urgency of the threat demands that we increase our focus.

Purpose In Action, or Purposeful Inaction?

After extensively analyzing our role in driving market trends, and acting out of a need to protect our clients’ long-term returns, we have identified two pivots that we have the ability to make this year—a structural adjustment to our exclusionary-screen indices, and a cultural adjustment to our shareholder action:

First, we are expanding a screen of non-Paris compliant companies to now apply by default to all ETFs, mutual and other broad indexed funds we offer, except when investors opt out and explicitly ask for these stocks. It is not enough to simply create exclusionary funds that screen out certain companies, because we offer thousands of products and most investors are passive. To make good on the threat I issued last year, we will begin this work by divesting from coal companies in our actively managed funds. Within 5 years, more than 90% of our 1000+ investment products will be converted to screen out non-Paris compliant companies such as coal, oil, and gas, which we see as declining and endangered. As a result, an increased percentage of our assets under management will align with our ESG values while sustaining high returns. This approach keeps responsibility in the hands of our clients, who will always have the choice to opt-out of our vision of a stable future and back into coal, oil, and gas.

Second, BlackRock will shift its approach to engagement. We have always supported management, but our clients have become impatient with companies that tout ESG values but do not align their planning to a Paris-compliant model. Beginning in 2019, BlackRock resolves to use our considerable stake in energy and related sectors to vote in favor of management only when we find them to be working toward net zero carbon emissions by 2050. We will use our shareholder position to keep companies accountable to resolutions that align with these values, and aggressively vote down those that do not. In cases where companies consistently fail to value long-term viability, we will vote out obstructionist boards and vote in members who are more forward-thinking.

This adds to the evidence that they must understand how much damage they're doing to the environment, assuming they actually want to know the truth, but they insist on trying to maximize short term profits, even though they know it will backfire on everyone, including themselves. Prior to this spoof letter BlackRock had been putting out statements to indicate they were concerned with Climate Change, and they continue to do so to this day; however, when this letter came out and some investors thought it was real they expressed outrage, and BlackRock was forced to admit that they didn't intend to do any of the things in the letter and that it was a spoof, which showed the real intentions of wealthy investors. While the spoof letter was forgotten within months, if not sooner, by MSM the deceptive propaganda was repeated over and over again, which is the way propaganda works. The lies are repeated over and over, while the truth falls down the memory hole, on the rare occasions where it comes out at all.

Now, in addition to making false propaganda claims about protecting the environment, BlackRock is producing ads about how they're handling pensions for working people, in the New England area highlighting a local fire department union that they're managing funds for. However, once again, it doesn't take much research to find out that they've previously been sued for looting pension funds, and more recently have been accused of funding Russia's war in Ukraine. Ironically, even though their propaganda to make themselves look environmentally friendly or socially responsible in other ways is almost all false, conservative groups are accusing them of being too "woke," which, intentionally or not, plays into their hands making it look like their propaganda is true even though it's not.

The bottom line is, if we continue to allow the wealthy elites with fanatical ideologies to control the propaganda we use to make important decisions, not only will they rig the economy in their favor turning most of us into virtual slaves, but they'll eventually destroy the planet as well, although I don't exactly how long it will take!

The decision has already been made, as demonstrated by the actions of powerful corporations, politicians, the media, and other in a position of power to resolve this problem; they're going to maximize short term profit even though they know, or should know, that it will destroy our planet and eventually themselves. There are plenty of environmentalists that recognize this, and are trying to change this; but they're not in a position to reverse it without help from wealthy elites, or a massive percentage of the public that currently remains complacent, and is going along with the program of the oligarchs. The majority of the public has indicated with their actions as well, they're not going to help unless the damage impacts them. So unless something changes soon things will get much worse before they get better, assuming they ever get better, even though we have the technology and ability to greatly reduce this problem, if not solve it.

Walmart Crime Report October 2022

Walmart had another fourteen shootings in October 2022, and five of them had one fatality each; although the first one, which wasn't fatal, happened in the last few hours of September, but wasn't reported in the media for several days, and wasn't reported in the previous Walmart Crime Report. This comes to one-hundred-thirty-two for the year with two holiday months to go, almost guaranteeing they will break the old record with a hundred-fifty-two or so shootings in 2019, which was so much more than any previous year that it seemed as if that record could hold for longer. There were also at least nine more injuries from the shootings, at least one of which is critical, and could potentially lead to another death. At least two of the shootings and one of the fatal shootings were officer involved shootings of suspects. several others were stand-offs with two or more people armed, possibly with both shooting at each other.

There was also a body found in a car at Walmart, bringing the total deaths to six, which although the shooting deaths are high, the total is lower than usual. There were also at almost a dozen, if not more than a dozen additional gun related crimes, including several armed robberies, including at least one stolen vehicle and another chase related to the armed robberies, several threats to shoot up Walmart or certain people. This may be a large underestimate, since news outlets seem to be less inclined to report major crimes than they used to, or they often omit important details from the headlines. There have been a growing number of incidents where Walmart's name has been omitted from stories, even when it was on their property, or times, where they were mentioned, but then articles have been edited to remove their name, and other times, where major incidents, like shootings, were not mentioned in the headlines, but buried in the articles. There's no guarantee this is an intentional effort to downplay crime at Walmart, but it's hard to imagine any other reason for changes in reporting methods.

Another police department, from Illinois this time, has called out Walmart for their high crime problems, and specifically pointed out the increase from self-checkout lanes; yet, even though this has been getting steadily worse every-time Walmart increases their reliance on automation, they keep doing it, and as I pointed out repeatedly, a large portion of the expenses for police, courts and prisons are paid for taxpayers, so we're essentially subsidizing their high crime problems, since without this subsidy, they would have more incentive to put the cashiers back so the problem can be reversed. Darien Ill. officials wants to charge Walmart $250 for each call after the first ten in any given month, which a Pennsylvania town is already doing. There are also a growing number of people on social media reporting about how Walmart is using a significant portion of the money they save on cashiers to fund high tech ways to catch people shoplifting at the self-checkout, and that this often also leads to an increase in false accusations. There have recently been at least two high profile cases where Walmart lost multi-million dollar lawsuits for making false accusations, although they're appealing at least one, and probably both.

Walmart also had numerous fights and brawls last month, including one at the self-checkout in Missouri that went viral on the internet with more than half a dozen, if not over a dozen people brawling that may have continued in the parking lot, as well as several other fights with a two to four people each, one where two employees fought each other, and another where an alleged thief attacked an employee with a bat, and another incident where two people attacked an employee while a third person video-taped it with his cell phone. There was also an incident where a police officer was injured trying to detain shoplifters, and another where shoplifters tossed wine-bottles and cookies in the store, after being caught.

There was an attempted child abduction at one store, and a former Walmart manager "charged with indecent liberties with a child" at another store. There were also at least two separate incidents with a large police presence, but it was unclear why, although in one of the incidences they tased a suspect, and at least of them involved evacuation of the store and closing it, but few details for either were in the news.

One Tennessee store had a rash of thefts, mostly stolen automobiles, and there were over half a dozen more automobile related crashes, chases, stolen vehicles, with two of those involving stabbings or attempted stabbings. Two of the crashes were into the store, with one trapping the drive in the car, since the front end went through the wall which was blocking the doors, and another major crash hospitalized four people, including two children, but there were no deaths.

Walmart had at least half a dozen more fires, with at least half of them arson, two allegedly committed by the same suspect, and one of them was a larger brush fire, which was natural and didn't expand into the store. The remaining two may have been suspicious, but the cause wasn't determined. They had close to a dozen or so knife attacks or threats, including two previously mentioned and at least four or five more stabbings, with the others threatening people. There were also several sex crimes, attacks against customers, a person smashing a window at a store that was closed due to the hurricane, and, as usual, more shopliftings than the media can ever report.

Another man plead guilty to fraud involving gift cards scamming hundreds of people; which is only a small fraction of the gift card scams, and Walmart refuses to take responsibility to make them more secure, often taking money from customers, making a profit off of fraudulent sales, and leaving the customer with nothing. They routinely refuse to take any responsibility, which other financial institutions rarely if ever did.

Walmart had at least two more recalls, including E-bikes with an explosion or fire risk, heating pads posing an injury risk, and there was one woman who said she found glass shards in Walmart meat, which happens several times every year, although it's not generally confirmed or refuted by Walmart, but there have been some exceptions where they have been confirmed independently, and where Walmart refused to take responsibility whether they could prove it was false or not.

A toddler allegedly got food poisoning from expired formula according to a parent as well. Walmart has a long history of fighting every lawsuit tooth and nail, and they always have plenty of them; however they're losing a growing number of them and settling others, which means they're accepting the outcome of those without appeals. They settled one discrimination lawsuit with a man in Maine, and another much bigger one with New Mexico over opioids, which may be followed by many more settlements. They lost a suit over an in-store bike crash and were ordered to pay $1.6 million, and were fined $146 thousand for pricing errors. They're also facing more labor claims about injuries, discriminatory applications, as well as accusations about increasing weights to charge more.

Walmart is increasing it's participation in clinical trials and using more women and minorities for research, which they portray as a good thing. How did a retailers with massive ethical problems become so involved in medical care and now research? Are we really supposed to believe that minorities haven't been used for research as much as whites, if not much more? And that being used for research is a good thing for the subject? There's very little media coverage about this in traditional media, but some obscure sources do a much better job covering this; and Harriet Washington author of "Medical Apartheid" and several other exceptional books on the subject has clearly demonstrated this is not the case. Poor people, especially minorities, are much more likely to be used as research subjects, while the rich control the benefits and rarely give adequate health care to the poor or minorities, whether it's based on recent research or not, and they use patents to gouge consumers, forcing them to go broke to get health care.

Walmart somehow managed to get a tax break, then responded by laying off thousands of workers in a Georgia fulfillment center, which is increasingly common for corporate America, where the government is clearly subsidizing unjustifiable income inequality that benefits campaign donors. There are also a growing number of social media posts bragging about how they either get fired or quit, with several claiming to be fired this month for petty reasons, and it hasn't been too long since several others quit in a high profile manner by using the PA system or other methods to draw attention to how they abuse their workers.

One article about Walmart makes an absurd claim that they convinced environmentalists that they can "save the world" by selling more stuff, whether people need them or not, instead of conserving and reducing the amount of waste, which is unsustainable. This is part of a massive green-washing tactic designed to keep people distracted, with people that pretend to be environmentalists help with their propaganda. The truth is that we've been using more natural resources in developed countries than the planet can reproduce of fifty years and counting, and it's getting worse. Many real environmentalists realize that it's obvious that we can't expand out of this problem, no matter how long and flattering Walmart propaganda looks. One of the better one is Bill McKibben, author of "Deep Economy" which somehow managed to become a best seller, even though traditional media gives little or no promotion for books like this. This book, along with other reliable sources, explains we need to stop buying more than we need and minimize waste, developing a Steady State Economy that isn't constantly expanding, instead of permanent growth economy with massive waste, to stop destruction of the environment, and eventually reverse it. The fact that this, and a handful of other good non-fiction books managed to be come a best seller, without any promotion from traditional media shows there might be hope for the grassroots, even if it's extremely difficult to overcome Wall Street's destructive and greedy propaganda.

Is there anyplace besides Walmart where the shoplifters are throwing wine and cookies around?

How many places are there where workers fight with each other because they're sleeping with the same manager?

Strange things happen at Walmart!

In 2006 Wake Up Walmart did a study, "Is Walmart Safe?" based on incidents in 2004, (PDF) about crime at Walmart which showed that it increased when Walmarts opened up and that crime was higher at Walmart than at other retailers. Since then Walmart Shootings began compiling a list of gun related incidents at Walmart and demonstrated that they have a large number of them, including on average more than one shooting per week somewhere in the country; now after counting them for several years that average is over two per week. In January of 2014 another study, "Rolling Back Prices and Raising Crime Rates?" provided additional statistical research indicating that Walmart might be contributing to higher crime rates or at least a slowing of the decline in crime. The study found that. “on average, communities with Walmarts had 17 more property crimes and two more violent crimes per 10,000 people than those communities without Walmarts.” I reviewed this more in Walmart’s crime problem, Rolling Back Safety more than prices? where I explained that although this study is helpful they could have done better with additional data that is available and I reviewed some of that. I also added my own review about why I think that Walmart policies have been contributing to higher crime in a previous blog, Walmart high crime rate continues un-investigaterd and have provided additional information under the author tag Walmart Crime Watch.

Stacy Mitchell has also compiled a list of other studies about Walmart and how they impact society, Key Studies on Big-Box Retail & Independent Business. To the best of my knowledge Walmart has done as little as they seem to get away with, often relying on rhetoric that isn't backed up with action, when it comes to addressing any of their critics concerns, including crime. One of the responses they’ve come up with is what they call "Restorative Justice" which gives first time shoplifters a chance to avoid being arrested or any criminal record if they take an on line course which costs $400 up front or $500 in payments, plus perhaps, reparations. This has been part of the privatization process and often denies suspects of the due process or access to a lawyer, perhaps even intimidating and extorting from some people that might not even be guilty. Walmart seems to be trying to find a way to turn crime into a profit making situation instead of looking for the most effective ways to reduce it. Making Change at Walmart is asking If you or someone you know has gone through @Walmart's "Restorative Justice" program for first-time suspected shoplifters, send us a DM. 03/30/2017 to ensure that it isn’t doing more harm than good. I did my own review of this program as well at Walmart’s “Restorative Justice” Endangers Public Without Reducing Crime. The following are a list of incidents that occurred in October 2022. According to the "Is Walmart Safe?" the average store in their sampling had 250 incidents per year indicating that these are only a fraction of the crime reports at Walmart, and presumably, the ones most likely to make the news on the internet nationwide. This isn't statistically representative, as the 2006 or the "Rolling Back Prices and Raising Crime Rates?" study or some of the studies cited by Stacy Mitchell; but it does provide some additional information that may help recognize how many problems there are at Walmart.

Miles City police looking for man after alleged threat to open fire in Montana Walmart 10/01/2022

MILES CITY — Miles City Police are searching for a man after he allegedly threatened to open fire inside the town's Walmart Saturday afternoon, according to Police Chief Doug Colombik.

MCPD dispatch received a call just after 3:00 p.m. saying several kids overheard a man in the Walmart bathroom say he was going to "shoot up the place." Colombik said officers arrived within minutes and cleared the building as they searched for the suspect inside. The building was locked down for an hour and five minutes. After not finding anyone matching the description, police reviewed surveillance camera footage and saw a person of interest come out of the bathroom and leave out the front door moments before officers arrived.

The kids - who relayed the information to a family member who then called dispatch - say they never saw a weapon, nor could one be seen in the video. Complete article

Deputies: Man threatens customers, employees with knife at Escambia County Fla. Walmart 10/01/2022

TikToker and Walmart customer Keaira shared two videos of the altercation, with the first gaining over 2.1 million views and the second getting over 185,000.

In the clip, the black-haired employee can be seen coming back into the store, yelling “Wayne… from OGP,” referring to the store’s online grocery pickup department.

She then gets on the store’s intercom system to expose her coworker and manager. “Attention all Walmart associates,” she said. “Wayne… from OGP has been having a constant affair… They’ve been trying to hide it. NY Walmart Ordered To Pay HV Man $1.6M Over In-Store Bike Crash 10/04/2022

ROCKLAND COUNTY, NY — Walmart Stores East LP has been ordered to pay $1.6 million to a Rockland County man over injuries he sustained while testing a bike in the Suffern store in 2016.

On August 6, a U.S. District Court jury in White Plains awarded a $3.1 million verdict to Cosmo Campodonico, of South Nyack. The amount was eventually reduced when it was determined that Campodonico was 51 percent liable for the bike accident, while Walmart was 49 percent liable.

The total took into account past damages of pain and suffering, medical expenses, future pain and suffering, legal fees, and interest for the 39 days after the verdict.

Walmart was directed to use approximately $634,000 of the judgement to purchase a 10-year insurance annuity to pay Campodonico around $61,000 annually with 4 percent increases every year. Complete article

Walmart settles discrimination suit filed on behalf of Skowhegan Maine man 10/04/2022

SKOWHEGAN, Maine — Walmart has settled a discrimination lawsuit filed on behalf of a longtime cart associate at the Skowhegan Walmart who has intellectual disabilities.

The suit, filed in November 2020, was settled for an undisclosed amount. It was filed by the Maine Human Rights Commission and Disability Rights Maine after the commission found reasonable grounds to believe Walmart had discriminated against the man when it refused to allow him to work a modified schedule, an accommodation his medical provider said was necessary.

The man worked for 20 years as a cart associate at the Skowhegan Walmart, returning carts from the parking lot to the store and helping customers bring things in or take things out of the store, the complaint stated.

The man's disability "substantially limits him in major life activities" including communicating, learning, speaking, thinking, and reading, and so is qualified to have "reasonable accommodations" including a modified work schedule and working with a job coach. Complete article

Walmart must face U.S. Labor Dept. claims over NY warehouse worker injury 10/04/2022

(Reuters) - Walmart Inc may have violated a federal workplace safety rule by failing to prevent heavy boxes from falling 40 feet and seriously injuring a New York warehouse worker, a U.S. appeals court said on Tuesday.

A unanimous three-judge panel of the 2nd U.S. Circuit Court of Appeals said a U.S. Occupational Safety and Health Administration (OSHA) rule requiring merchandise "stored in tiers" to be secured can apply whenever goods are kept on tall metal racks.

OSHA, a part of the U.S. Department of Labor, and Arkansas-based Walmart did not immediately respond to requests for comment.

OSHA in 2020 had fined Walmart about $11,000 after cases of crescent rolls fell off a pallet at a warehouse near Albany, New York, injuring a worker. Complete article

Walmart’s supposed rollout of new self-checkout technology has customers on high alert, as evidenced by one recent TikTok video in which a woman says she almost went to jail because of a store’s new upgrades.

TikToker @brianathebreeder posted a video of herself walking through the Walmart parking lot with her purchases with the caption: “walmart is not green no more…almost went to jail bc of the new self checkout update.” She further captioned the video, which was viewed more than 300,000 times, saying, “lmaoo [they] showed me not scanning & all…be safe y’all.”

It wasn’t clear what Walmart location @brianathebreeder is highlighting in her video.

Finessing Walmart’s self-checkout system has gotten people in trouble with the law before. For example, one Texas woman was recently arrested after attempting to scan fake barcodes in the self-checkout line, according to WREG.

The woman allegedly used a barcode that charged items for 25 cents but owed over $100 dollars for the items she attempted to take with her. As she made her way out of the store, she was followed by loss prevention officers, and police later arrived at the store, according to CBS 4 News in the Rio Grande Valley. Her bond was reportedly later set at $3,000. Complete article

Walmart moves to toss lawsuit over pot screenings for job applicants 10/10/2022

Oct 10 (Reuters) - Walmart Inc has asked a federal judge in New Jersey to rule that the state's law barring employers from refusing to hire job applicants because of their off-duty marijuana use can only be enforced by the state, and not individual workers.

Walmart on Friday asked the judge to toss a proposed class action filed in June, arguing that a New Jersey law legalizing recreational marijuana use gives a state commission exclusive enforcement powers and does not authorize private lawsuits.

The lawsuit accuses Walmart and subsidiary Sam's Club of violating the law, which took effect in April, by using positive marijuana tests to screen job applicants.

Walmart's motion comes as an increasing number of states legalize recreational marijuana use and employers grapple with balancing new legal protections for workers with concerns about workplace safety. Complete article

‘F**k you, Lisa!’: Walmart worker goes off on manager after claiming to be ‘wrongfully’ fired 10/12/2022

'Worked on that jean wall for over 3 hours for her to fire me as soon as I was done.'

A TikToker by the name of Alayna (@diaryofawimpyalayna) uploaded footage of her last day of work at Walmart after she was fired. In a text overlay for the now-viral clip she writes, “pov: walmart wrongfully fired you.”

The clip begins with a video screengrab of a recording from someone informing Alayna that she was “terminated.” The video then cuts to the TikToker knocking on someone’s door with her arms crossed, and then straight to her pulling jeans off of shelves and onto the floors. The video ends with a close-up of Alayna’s face as she shouts out into the store, “Fuck you, Lisa!”

In the comments section of the post, Alayna explained why she decided to wreck the shelves of jeans. She said her manager waited to fire her until after she arranged all of the clothes to break the bad news. “Worked on that jean wall for over 3 hours for her to fire me as soon as i was done, so she can work on it now,” she wrote. How Walmart convinced critics it can sell more stuff and save the world 10/13/2022

On a warm Arkansan evening, a jazz quartet has drawn a crowd outside Walton’s five and dime in the main square. It’s been 60 years since Sam Walton expanded from this small shop to open the first Walmart discount store nearby, and 30 years since he died. But “Mr Sam” and his company still dominate Bentonville. There’s one of its Neighborhood Market shops a block away, an outdoor clothing outlet in the other direction and a giant Supercenter just across Walton Boulevard. Even the throwback soda fountain next to Walton’s has been subsumed by the Walmart museum, which is funding tonight’s entertainment.

In the audience, a boy is riding a coin-operated truck, a model of the beaten-up Ford pick-up that helped cement Walton’s image as a frugal, quail-hunting man of the people even as he became America’s richest individual. A replica greeted me at the local airport, and the original is in the museum. Walking through the old shop to see it, I find books of Walton’s folksy business wisdom, the moon pies he once sold 500,000 of in a week by cutting their price and T-shirts bearing the truck’s image. At just $5, I can’t say no.

Walton’s understanding of our inability to resist a bargain built the empire that now employs 2.3mn people, stretches from India to South Africa and commands a market value of roughly $350bn. His drive to offer irresistible deals relied on a business model that kept wages at a minimum, sourced products from the world’s cheapest suppliers and was hostile towards investing in anything that would not sell another T-shirt or moon pie. Squeezing costs to lower prices for consumers was Walton’s definition of purpose. “Our vendors resented us for prying the lowest prices out of them,” he wrote in his memoir, but “our philosophy . . . has been simple: we are the agents for our customers.”

The expectations placed on today’s business leaders are less straightforward. Employees, customers, investors and activists are pressing them to use their heft to solve the very social and environmental problems some blame them for creating. In place of the focus on shareholder returns that drove Sam Walton’s generation, America’s biggest industry groups have pledged themselves to “stakeholder capitalism”, the notion that they can be a force for good by serving all of their constituencies equally. Soon after the Business Roundtable, the powerful lobbying group, committed itself to that goal in 2019, it announced a new chair: Walmart chief executive Doug McMillon.

Over the past year, scepticism about this definition of corporate responsibility has grown rapidly. “The Bully of Bentonville”, as one 2006 book dubbed Walmart, has always faced criticism from those on the left who mistrust big business and bridle at its efforts to crush unions. Now influential voices on the right have joined them, claiming that corporate America is pushing a radical progressive ideology. “Corporate power has increasingly been utilised to impose an ideological agenda on the American people through the perversion of financial investment priorities under the euphemistic banners of environmental, social and corporate governance and diversity, inclusion and equity,” Florida’s Republican governor Ron DeSantis charged in August. The rightwing pundit Dinesh D’Souza put it more bluntly: “Walmart has gone woke”. Complete article

The former CEO of Walmart U.S. left the $300 billion retailer to lead Air New Zealand. Just days in, business screeched to a halt: ‘We went from doing $100 million a week to nothing’ 10/14/2022

Greg Foran’s decision in 2019 to step down as CEO of Walmart’s $300 billion-a-year U.S. business and lead Air New Zealand took retail industry observers by surprise. After all, Foran is credited with revitalizing Walmart’s massive fleet of 4,500 stores and adapting them to e-commerce. Why would he walk away from one of the most prominent jobs in retail, and what did he know about running a small airline anyway?

After eight years in the U.S. and China, Foran was ready to return to his home country of New Zealand and was drawn to the opportunity to be a CEO with no one above him (Walmart U.S.’s CEO reports to the CEO of Walmart Inc.). While Foran acknowledges a large difference between running a gigantic retailer and a national air carrier, he says there are common threads.

He was only a few days into his job as the airline’s CEO in February 2020 when the pandemic hit, forcing him to tap many of the skills he developed at Walmart U.S. CEO and map out the airline’s revitalization plan. “It’s similar to the playbook I had at Walmart U.S., which was similar to the one I had in China, which was similar to the one at Woolworths,” Foran tells Fortune, referring to the giant retailer down under. “You’ve got to decide what kind of culture you want the business to operate in,” he says. More importantly, “You’ve got to be great at the basics.”

With air travel stalled, Foran set about devising a plan to reinvent the airline, focusing on dominating select routes, building more market share in its home country, and improving customer service. Complete article

Walmart heiress Alice Walton’s financial ties to Canoo CEO revealed in court filings 10/14/2022

When electric vehicle company Canoo was facing a cash crunch this summer, Walmart offered a lifeline in the form of a direct investment as well as a contract to purchase several thousand of the company’s cars.

The ties between Walmart and Canoo appear to go deeper, however, in light of financial ties between one of Walmart’s largest shareholders, Alice Walton—daughter of the late Walmart founder Sam Walton—and Canoo’s chief executive, Tony Aquila.

While it is unclear whether Walton has invested in Canoo directly, new court documents filed in Illinois federal court this week formally link Alice Walton and the Walton Family Office to AFV Partners, Aquila’s personal private equity firm that owns a minority stake in the electric vehicle company. (Fortune has previously reported on the connection)

In one of several depositions filed this week, a former principal at AFV Partners, Ryan Aprill, who is one of two plaintiffs in the case, asserts that he and Aquila had a phone call on Aug. 4, 2019, in which they discussed Alice Walton’s backing of AFV Partners.

“I needed to ensure that we had a minimum funding level to support that salary,” Aprill said in the deposition testimony, in reference to his minimum base salary they were allegedly discussing at the time. “[Tony Aquila] assured me we did from the Walton Family Office, Alice Walton in particular.” Complete article

Texas man with hatchet arrested at Walmart after scaring the ‘bejeebies’ out of people 10/16/2022

Texarkana police accused Jerry Toney of rushing up to people in the mega store’s parking lot with a hatchet attached to the front of his pants as he screamed things “that made absolutely no sense.”

“Obviously his very bizarre behavior was scaring the bejeebies out of the people he was running up on,” the police department said Friday in a Facebook post about the Oct. 7 incident.

Authorities noted he never actually took the hatchet out of his pants to directly threaten anyone during his alleged antics. Complete article

US businesses propose hiding trade data used to trace abuse 10/17/2022

A group of major U.S. businesses wants the government to hide key import data -- a move trade experts say would make it more difficult for Americans to link the products they buy to labor abuse overseas.

The Commercial Customs Operations Advisory Committee is made up of executives from 20 companies, including Walmart, General Motors and Intel. The committee is authorized by U.S. Customs and Border Protection to advise on ways to streamline trade regulations.

Last week -- ahead of closed-door meetings starting Monday in Washington with senior officials from CBP and other federal agencies -- the executives quietly unveiled proposals they said would modernize import and export rules to keep pace with trade volumes that have nearly quintupled in the past three decades. The Associated Press obtained a copy of the proposal from a committee member.

Among the proposed changes: making data collected from vessel manifests confidential. ....

The proposal, if adopted, would shroud in secrecy customs data on ocean-going freight responsible for about half of the $2.7 trillion in goods entering the U.S. every year. Rail, truck and air cargo is already shielded from public disclosure under U.S. trade law.

“This is outrageous,” said Martina Vandenberg, a human rights lawyer who has filed petitions with CBP seeking to block shipments of goods suspected of being made by forced labor.

“Every year we continue to import and sell millions of dollars in goods tainted by forced labor,” said Vandenberg, president of the Washington-based Human Trafficking Legal Center. “Corporate America should be ashamed that their answer to this abuse is to end transparency. It’s time they get on the right side of history.” Complete article

‘I would say go diving, but they crush it all’: Ex-Walmart worker reveals what happens to lightly blemished products at the end of the night 10/19/2022

A former Walmart employee went viral on TikTok after revealing how the corporate giant allegedly handles lightly damaged products at the end of each night.

User Benson (@ayoitsbenny) notes via text overlay that he’s no longer a Walmart employee, so he shared a video from his time at the superstore chain. Benson shows a series of slightly damaged products from the store’s inventory. He films a few open bags of dog and cat food, cleaning products, laundry detergent, cat litter, salsa, and pudding. With the exception of the detergent and the open bags of pet food, Benson deemed all of the products “good,” however, he says they’re required to throw the items away because they were out on the shelves for “too long.”

“And this is what we do with them, courtesy of Walmart,” Benson says, flipping the camera to reveal a trash chute as he chucks the items down.

He added in the caption that the chute crushes each item thrown in, so they are unsalvageable. “This is what we did towards the end of every night. Had this one saved for after I left. I would say go diving, but they crush it all,” he wrote. Complete article

SHOPPING SECRETS I’m a retired cop – Walmart doesn’t want you to know a hidden detail about the cameras watching you at self-checkout 10/23/2022

Former police officer Tim Dees shared that many of the store's cameras are only for show and are actually empty.

Tim was answering the question: "Why is Walmart so big on preventing shoplifting by telling you that there are security cameras everywhere if their prices are so low?" on popular Q&A platform Quora.

But while many responded with their experience of how the supermarket chain "comes down hard" on thieves, Tim had a surprising answer.

Walmart received $23M in Georgia tax incentives. Now, it's laying off 1,400 workers. 10/26/2022

It's not common for a state to offer companies large incentive packages that will close or begin large-scale layoffs in less than 10 years.

Georgia’s incentives were contingent on Walmart's ability to hire 450 jobs paid $12-14 an hour in a 36-month time frame, according to an offer letter from the economic development department. The company met its performance commitments, according to a spokesperson from the department.

It's not common for a state to offer companies large incentive packages that will close or begin large-scale layoffs in five to 10 years, site selection expert Kim Williams Davis wrote in an email to Atlanta Business Chronicle.

But it does happen. Economic changes or decisions like mergers, acquisitions or shifts in company strategies can occur over time. For example, Walmart has been investing more in automation, which could reduce the number of jobs needed at a facility.

“There's a risk-reward calculation that states make when offering incentives,” said John Boyd, founder and principal of site selection firm The Boyd Co. Inc. “That Walmart facility was a major economic engine for several years and employed thousands. That said, we’re in an economic downturn. You have major e-commerce giants scaling back their operations.”

This is why states offer performance-based incentives that are paid out once a company meets certain thresholds. Some incentive agreements also include "claw back" provisions, which require companies to pay back funding if they do not meet the capital investment, job creation or wage numbers that were agreed upon during negotiations. Walmart fined $146K for errors on labels meant to help shoppers compare prices 10/28/2022

Ever try to figure out if it’s more cost effective to buy the big can of coffee or the smaller one? Or the 20-pack of beverages instead of a 12-pack?

Many consumers assume buying the larger package will cost less per item, but that’s not necessarily the case.

To help consumers make that determination without having to pull out a calculator, stores are required to post what’s known as the “unit price” for regulated products. Those units of measure, such as ounces, pounds, pints, 100-counts and so on, help shoppers figure out whether a larger or smaller package offers a better value.

Walmart has been fined more than $146,000 since the beginning of the year by the New Jersey Division of Consumer Affairs for mistakes in how it posts these comparative measurements at some of its New Jersey stores, NJ Advance Media has learned. Complete article
