Walmart Crime report August 2017

Gun crime at Walmart has taken a surprising drop last month; however most other major crimes are as high as ever and three of the only four shootings that happened on the property or as a result of a shoplifting both resulted in deaths. There were only a handful of other gun related crimes including a brawl over school supplies where a woman pulled a gun in an argument over who would get the last notebook. There were an additional three shootings close to Walmart and one of those also led to a death. At least seven deaths happened at Walmart or as a result of a shooting or shoplifting chase that began there, including three bodies found in parking lots and a teen that was thrown from a truck. I'm not ruling out the possibility that low profile coverage or avoiding using Walmart's name in news coverage could be responsible for this unusual drop, since it is so much less than they've had for years and two of these shooting didn't use Walmart's name and wouldn't have turned up in regular searches. One of the deaths as a result of a teen being thrown out of a truck wasn't reported until a week after it happened either. There have been subtle signs of the media favoring Walmart with their coverage; however it is unlikely that they could down play shootings much if at all for long, like they have been doing with bomb threats or shoplifting, which is easier to ignore.

A Minnesota lawmaker and candidate for Attorney General is speaking out about conflicts of interests in their "Restorative Justice" program which is attempting to take over legal functions carried out by the courts as their plan to reduce crime. This mostly just reduces reports to the police about petty shoplifting since they've been exposed as having much worse problems with this than any other store for decades. Reports of this have gone back decades, however it wasn't until recently that the mainstream media finally came to the conclusion that they couldn't completely ignore them. I went into this more at Walmart’s “Restorative Justice” Endangers Public Without Reducing Crime.

Another new Walmart in Illinois has reported how crime reports to that store and in the town skyrocketed in the first year they opened, which is routine, although reporting on it promptly, at least at the local level, is relatively new. A Tennessee judge has rejected practices of using burglary statutes, which were intended to treat breaking and entering in peoples homes or business more seriously than petty theft, to prosecute shoplifting as a misuse of the law. Prosecutors from that state are arguing against it, as part of a practice of treating those that steal from Walmart far more harshly than white collar crimes, often committed by the rich including Walmart executives, against the poor or middle class. Another increasingly common practice is what many states call "felony shoplifting," which many politicians are using more of to get tough on blue collar crime while ignoring the fact that the reason why Walmart has so much problems with crime is that they haven't adequately secured their own property and are a virtual magnet for crime. They continue increasing their reliance on self-check out lanes and a new scan and go technology even though they know it is being accompanied by massive increases in theft, with the tax payer footing the bill for prosecution unless they try to charge petty thief for their restorative Justice program.

A couple articles came out this month about how there have been a lot of brawls and sex crimes happening at Walmart for years, which is true; and both of these types of crime have if anything gone up this month, unlike gun crime; however they both only report on a small fraction of both types. There have been dozens if not hundreds or thousands of them reported over the years, although most of them are only reported at the local level. Some of the sex crimes are relatively mild like people getting caught masturbating in their cars or indecent exposure; but other are much more extreme in one case a pedophile went into the girls bathroom and stuck his head under the stall until she screamed and scared him away, and more serious attempts at kidnapping or rape.

One of their managers was fired for trying to stop thieves and taking their licence number after he failed which is very common. Their own employers are often given mixed messages about what they're supposed to do to stop crime and if they need someone to blame for problems they're quick to fire for many reasons, often leading to massive publicity, at the local level.

There were at least six fires at Walmarts this month including three arson, one that was part of a theft attempt and another that was allegedly done because the dressing room was locked or the suspect had ADHD; three kidnapping or carjacking attempts; a few pepper spray incidents and a dozen or more assaults purse snatching, brawls for one reason or another including fights about places in line or petty theft; and over half a dozen crashes or chases including a couple where police were hit with cars and two where vehicles smashed past the doors into the aisle, one of them went all the way to the back in the electronic section before backing all the way out and was clearly intentional.

One of their disgruntled former employees decided to take a 24-pack of beer as a consolation for being fired; that didn't work out for him.

Walmart is always involved in many lawsuits, including two this month were they were exposed for discrimination against transgender; another were they were sued for firing a worker for taking care of a sick child; and they settled their case against Tracy Morgan, secretly, but it's still obvious he got a much better deal than any non-celebrity could ever get.

They may face a suit over a prescription drug claim where a woman says she received multiple types of drugs in her prescription; Walmart refutes this but even if they're being falsely targeted they get caught lying so often they might sound like the boy who called wolf on the times where they really are innocent. The same goes for a photo that went viral of a gun display that says "own the school year like a hero" and Walmart claims it was a prank; but they won't say how they came to this conclusion or where it was which makes many people doubt them.

Their Chile stores settled with local workers avoiding a strike which should have gotten much more attention since they have a history of shutting down stores on the rare occasions where employees unionize.

They also had another public relations disaster when falsely accusing disabled friends of shoplifting. These are just a handful of their public relations problems but instead of trying to treat customers or workers better they're spending "more than $18 million on tear-jerking ads to fix its infamous reputation," presumably they're counting on those that don't recognize that almost all public relations ads are distortions or outright lies, including these.

Rob Walton sold $51 million worth of Walmart stock, in a little reported story, at its peak before it dropped again. Insiders manage to do things like that.

They also had a bird attack on an elderly woman and frozen worms in their fish and three or four men streaking through Walmart or their parking lot naked.

Someone claiming to be "Alice Wonderland" was allegedly told to go on a rampage with a forklift at a Walmart under construction until police stopped him at gunpoint but a "hookah-smoking caterpillar.”

I could have made these things up but I didn't have to.

Strange things happen at Wal-Mart!

In 2006 Wake Up Wal-Mart did a study, "Is Wal-Mart Safe?" based on incidents in 2004, (PDF) about crime at Wal-Mart which showed that it increased when Wal-Marts opened up and that crime was higher at Wal-Mart than at other retailers. Since then Wal-Mart Shootings began compiling a list of gun related incidents at Wal-Mart and demonstrated that they have a large number of them, including on average more than one shooting per week somewhere in the country. In January of 2014 another study, "Rolling Back Prices and Raising Crime Rates?" provided additional statistical research indicating that Wal-Mart might be contributing to higher crime rates or at least a slowing of the decline in crime. The study found that. “on average, communities with Walmarts had 17 more property crimes and two more violent crimes per 10,000 people than those communities without Walmarts.” I reviewed this more in Wal-Mart’s crime problem, Rolling Back Safety more than prices? where I explained that although this study is helpful they could have done better with additional data that is available and I reviewed some of that. I also added my own review about why I think that Wal-Mart policies have been contributing to higher crime in a previous blog, Wal-Mart high crime rate continues un-investigaterd and have provided additional information under the author tag Walmart Crime Watch.

Stacy Mitchell has also compiled a list of other studies about Wal-Mart and how they impact society, Key Studies on Big-Box Retail & Independent Business. To the best of my knowledge Wal-Mart has done as little as they seem to get away with, often relying on rhetoric that isn't backed up with action, when it comes to addressing any of their critics concerns, including crime. One of the responses they’ve come up with is what they call "Restorative Justice" which gives first time shoplifters a chance to avoid being arrested or any criminal record if they take an on line course which costs $400 up front or $500 in payments, plus perhaps, reparations. This has been part of the privatization process and often denies suspects of the due process or access to a lawyer, perhaps even intimidating and extorting from some people that might not even be guilty. Walmart seems to be trying to find a way to turn crime into a profit making situation instead of looking for the most effective ways to reduce it. Making Change at Walmart is asking If you or someone you know has gone through @Walmart's "Restorative Justice" program for first-time suspected shoplifters, send us a DM. 03/30/2017 to ensure that it isn’t doing more harm than good. I did my own review of this program as well at Walmart’s “Restorative Justice” Endangers Public Without Reducing Crime. The following are a list of incidents that occurred in August 2017. According to the "Is Wal-Mart Safe?" the average store in their sampling had 250 incidents per year, indicating that these are only a fraction of the crime reports at Wal-Mart, and presumably, the ones most likely to make the news on the internet nationwide. This isn't statistically representative, as the 2006 or the "Rolling Back Prices and Raising Crime Rates?" study or some of the studies cited by Stacy Mitchell; but it does provide some additional information that may help recognize how many problems there are at Wal-Mart.

See the Fiery Letter Elizabeth Warren and Other Senators Just Sent to Walmart and Target 08/01/2017

A group of influential Democratic Senators is calling on national retailers to crack down on alleged abuses that have forced truckers into schemes that essentially turn them into modern-day indentured servants.

This week, U.S. Senators including Elizabeth Warren, Sherrod Brown, and Kamala Harris sent letters to the heads of 16 major retail brands, expressing grave concerns about the practices reported in a June investigative report published in USA Today.

The report detailed how port trucking companies in southern California "have spent the past decade forcing drivers to finance their own trucks by taking on debt they could not afford." The "companies then used that debt as leverage to extract forced labor and trap drivers in jobs that left them destitute," the paper explained.

In many cases, drivers say they were basically paid pennies per hour, or even worked for free because their pay was automatically taken away to cover fees mandated by the arrangement. Drivers also felt forced to be on the road up to 20 hours a day, a situation that's obviously dangerous for the drivers themselves as well as anyone else on the road. What's more, if a driver quit before the debt was paid off, the company could take his truck and not even reimburse the driver for the equity paid into it. Complete article

UPDATE: No injuries reported in Camden Delaware Walmart crash 08/03/2017

No injuries were reported as the Delaware State Police continue their investigation into a multi-vehicle crash south of Camden.

Delaware State Police spokesman Master Cpl. Gary Fournier said the incident occurred around 9:44 a.m. Wednesday, August 2, as Calvin L. Anderson, 66, of Gales Ferry, Connecticut, was driving a 2003 Freightliner Century and pulling a trailer in the northbound, right lane of South DuPont Highway coming up on Thomas Harmon Drive, aka the entrance to the Camden Walmart entrance.

Fournier said Anderson did not see traffic in front of him stopping at a red light when he ran into the back of a trailer being pulled by a 1997 Dodge Ram pickup truck. This, in turn, caused the Dodge to move forward and hit the rear of a 2013 Mercedes-Benz GLK350.

The tractor trailer then swerved into the left lane and hit the back end of a 2008 Ford Escape and then went back into the right lane where it hit the trailer and pick up truck again before stopping and bursting into flames. Complete article

Walmart Settles With Insurers Over Crash Settlement Payments to Tracy Morgan 08/07/2017

Walmart has settled a lawsuit by two insurers that sought to avoid covering its multi-million-dollar payout to comedian Tracy Morgan for injuries he suffered in a 2014 crash involving one of the retailer's trucks.

U.S. District Judge Freda Wolfson in Trenton, New Jersey, on Monday ordered the dismissal of all claims against Walmart by Ohio Casualty Insurance and Liberty Insurance Underwriters, and all counterclaims by Walmart against the insurers.

Terms of the settlement are confidential, and both sides agreed not to bring their claims again.

"We are pleased to have resolved this matter," Walmart spokesman Randy Hargrove said in an email.

The accord came 2-1/2 months after the insurers, both affiliated with Liberty Mutual Group, had sought permission to question Morgan and another injured passenger, Ardley Fuqua, to help them determine whether Walmart paid too much. Complete article

Walmart found guilty of ‘harassment & intimidation’ of transgender Fla. employee 08/07/2017

Jessica Shyne Robison was a stellar employee for Walmart owned subsidiary Sam’s Club when she told her manager she would be starting the transition process. While she received several promotions and kudos during her career pre-transition, things quickly turned sour after she came out as trans.

Robinson was “subjected to harassment and intimidation” by her supervisor according to a ruling from the federal Equal Employment Opportunity Commission (EEOC). They also found that her exclusion from the corporate health care policy violated the law.

The commission found that the company “categorically excluded coverage of any services for ‘transgender treatment/sex therapy,’ denying [Robinson] medically necessary care that would have been covered if not for her transgender status” according to the ruling. Walmart recently settled a class action lawsuit brought by several former and current gay and lesbian employees who were denied health insurance coverage for their spouses. Complete article

Walmart Stores Turn Haven For Sex Offenders? 08/08/2017

A 25-year-old Florida man has been arrested after he touched two girls at a Naples Walmart store inappropriately Aug.4. The girls, aged 8 and 11, were purchasing stationery items at the "Back to School" section of the store when the man allegedly groped them, according to reports.

The two families were shocked when they learned the girls were groped in separate incidents by the same man, Eric Wrobleski. One of the two girls, aged 11, told her mother Wrobleski grabbed her from behind. The girl's mother complained to the store management that notified the Collier County Sheriff's Office. Hours later, another 8-year-old girl also complained to her mother the same man touched her in a similar manner while shopping, the New York Daily News reported citing an arrest affidavit. Wrobleski was arrested the same day.

Such cases are not unheard of at the Walmart stores. In June, at least 16 registered homeless sex offenders listed the Walmart store at Clearlake Road, Cocoa, in Florida as their home address, ABC-affiliate WFTV reported.

Under the state law, homeless sex offenders can register themselves by providing the nearest physical address. Complete article

Brooks is accused of threatening the life of a Walmart employee’s child if she didn’t give him Visa gift cards worth close to $18,000 in June 2017. As a result of the threat, the female was in fear for her child’s safety and Brooks, in turn, received the cards without paying for them, police said.

Once arrested, Brooks is expected to be charged with blackmail/extortion and obtaining property under false pretenses. Complete article

Okla. Walmart refutes woman’s claim of prescription mix up; State pharmacy board investigating 08/09/2017

OKLAHOMA CITY - An Oklahoma City woman has filed a complaint with a state regulatory board after claiming a Walmart pharmacy gave her three different prescriptions in one pill bottle, which the retailer says it couldn't confirm.

Gina McCurtain says a prescription, filled in early July for pain medication from a recent shoulder surgery, had two other similar looking pills inside the pill bottle, some of which she says she inadvertently took for about two weeks.

“I started getting real fast heartbeat, didn’t know why," said McCurtain, a mother of three and diabetic.

McCurtain says the pharmacy, located inside the Walmart Neighborhood Market at 2217 NW 23rd St., filled her first prescription of Percocet correctly after she had shoulder surgery in June. But it wasn't until late July that she and her husband took a closer look at the pills in the second prescription filled on July 11.

“My husband noticed it right away that there were two different kinds," she said.

When the pills were taken back to the pharmacy on July 25, two other medications were found intermixed with the Percocet: Methocarbamol, a muscle relaxant, and Bupropion, an anti-depressant. Complete article

Viral Facebook post probe finds two events happened at same time at Tega Cay SC Walmart 08/09/2017

A viral account of a possible abduction attempt in Tega Cay a mystery to police earlier in the day, had an explanation several hours later.

“We have found no truth to that,” said Maj. Dave Nelson of the Tega Cay Police Department in reference to a Facebook post Tuesday by a woman who said she feared for the lives of her children and herself at a Walmart. .....

“While (Walmart’s) Loss Prevention was watching video of the suspicious person, they observed a different individual stealing beer,” the city wrote in its post. “They went to stop that person who ran and jumped in a car with several other people and fled the scene.

"The customer who felt she was being followed thought the same people who ran were the ones watching her. The customer was not aware of the second incident and thought the suspects in the vehicle were part of the same concern she had reported to the store.”

Also in the post, the city wrote, “From the initial police investigation, it appears from the suspicious male committed no crime. The police can confirm they had a shoplifting of beer occur at the same time and the suspects have not been identified.” Complete article

Suspect tried to commit lewd acts on girl in Ca. Walmart restroom the day after he was convicted of sexual battery 08/0/2017

An Oak Hills man was convicted of sexual battery one day before he was arrested Wednesday on suspicion of entering a Palm Springs Walmart restroom stall that was occupied by a 13-year-old girl.

Tyler Berthoud was convicted Tuesday in Riverside County Superior Court of sexual battery, according to court documents. He was sentenced to one year in jail but had already accumulated enough time credit served to secure his release Tuesday - the day before his 25th birthday.

On Wednesday, Palm Springs police responded to a call shortly after 3 p.m. regarding "lewd conduct" at the Walmart on Ramon Road. A young girl was in a restroom stall at the superstore when the suspect poked his head from underneath the stall's wall. He entered, pulled down his pants and began to masturbate in front of the child, Palm Springs police Sgt. William Hutchinson said.

“This has got to be a very, very scary thing, I don’t care if you’re 13 or you're 40,” he said. “This is a very brazen, dangerous individual that we don’t want in this community.” Complete article

'Justice' in store: Minn. Lawmaker pushes back against Walmart program 08/10/2017

Not everyone stopped for a crime at the nation's largest retailer enters the criminal justice system.

First-time nonviolent shoplifters at Walmart can be eligible for a program the company said is making a difference at its stores, though the program itself is taking heat from a Minnesota lawmaker.

The restorative justice program at Walmart is among efforts the company has rolled out since 2014 in the face of criticism about crime at its stores. A RiverTown Multimedia analysis of 2016 calls for service to Walmart stores in five cities revealed law enforcement is called an average of 3.69 times for every call to Target stores. ......

Not everyone's sold on the program, however.

Minnesota Rep. John Lesch called the program an "off the books probation department" that he fears denies due process to suspects apprehended by store security.

Though the program is voluntary, the St. Paul Democrat said that's not always clear to suspects who think they're dealing with a government entity, rather than a business-driven program.

"Walmart is treading very closely, if not wading directly into, the role of a government prosecutorial entity," he said, "and I have huge issues with that."

Lesch, a candidate for Minnesota attorney general, also registered concerns with the fees charged in the program, calling it "a profit center" to fund Walmart's security. Complete article

Mother finds a worm frozen inside a piece of Walmart fish 08/11/2017

On busy weeknights, frozen foods can be a healthy, inexpensive, and easy way to feed your family. But after you see what this mother found in her frozen tilapia, you may find yourself avoiding the frozen food section all-together.

A mom in Greenville County, South Carolina found what looked to be a small snake frozen inside a piece of tilapia, according to WTXL ABC 27. The woman bought the tilapia, which is farm-raised in China, at Walmart.

Her daughter was rumbling through the freezer, and then she asked her mom if she had seen the snake. They opened the vacuum-sealed package and were shocked by what they saw on the boneless, skinless piece of tilapia. An aquaponics professor at Clemson University said it was not a snake, but it looked like it could be a nematode or a tapeworm.

The mother went back to Walmart to show them the piece of fish. A manager offered her a refund for the $5 bag, but that wasn't enough. "It wasn't just giving me my money back that was a concern, it was just them doing the right thing," she told WTXL ABC 27. She wants the Fishin Tilapia Fillets, which are "aquaculture practices certified," according to Walmart's website, to be taken off the shelves. Complete article

Jacksonville Fla. mother says her child was nearly kidnapped at Walmart 08/11/2017

Monday, Katie Stukes said she was checking out at the Walmart on Collins Road, when a woman came up and got much too close to her daughter.

Stukes rushed outside, put her daughter, Kennedi, in her truck, and locked the doors.

But the police report states the encounter continued out in the parking lot.

“She came up from behind me right here, like right here, close to me,” Stukes said. “She yelled 'Babe!' like she was trying to play off why she was out there. My first thought was some big man is about to roll up in his car and take both of us.” Complete article

Walmart has spent more than $18 million on tear-jerking ads to fix its infamous reputation 08/08/2017

Walmart is spending millions of dollars to make sure Americans know about investments that might rehab the retailer's reputation.

Additionally, the company has spent roughly $650,000 on emotional commericals in the past year highlighting a new worker training program called Walmart Academy.

Wal-Mart takes battle with Amazon to the skies with floating warehouse patent filing 08/18/2017

The world’s largest retailer has applied for a U.S. patent for a floating warehouse that could make deliveries via drones, which would bring products from the aircraft down to shoppers’ homes.

The blimp-style machine would fly at heights between 500 feet and 1,000 feet, contain multiple launching bays, and be operated autonomously or by a remote human pilot. Amazon was granted a patent for a similar vessel in April 2016.

The migration to the skies represents the latest volley in a clash between Wal-Mart and Amazon to grab shoppers’ attention, loyalty and dollars. In the process, the companies are increasingly treading on the other’s turf: Amazon is opening physical stores and agreed to pay $13.7 billion for upscale grocer Whole Foods Market. Wal-Mart, meanwhile, has beefed up its e-commerce business through acquisitions and offers like free two-day shipping. Complete article

Effingham County Sheriff’s deputies were on the lookout at 7:45 p.m. Friday for a black Chevy Impala that was the suspect vehicle in a shoplifting at Walmart, according to Sheriff’s spokeswoman Gena Bilbo.

A deputy tried to stop the speeding car on Ebenezer Road, but the driver refused to slow down or stop.

During the pursuit the passenger, Thomas Preston Schmidt, threw items out of the window. The driver, Tiffany Marie Lee, lost control, drove into a ditch and struck a light pole.

As deputies were approaching the car, she tried to flee again by backing up and striking the deputies’ vehicle and almost striking a deputy.

The pursuit continued until Lee finally lost control and drove into a field. Lee exited the car and ran, but was arrested and taken into custody after a short foot pursuit. Complete article

Rio Rancho NM officers shoot, kill suspect after short pursuit starting at Walmart where first shooting took place 08/22/2017

A man suspected in a shooting at a Walmart is dead after Rio Rancho police officers opened fire during a short pursuit in a quiet neighborhood on Albuquerque’s West Side on Tuesday morning, according to a spokesman for the police department.

Captain Ron Vigil said shortly after 7 a.m. officers were called to the Walmart Supercenter on Unser and Southern SE to investigate a call about a shooting. He declined to provide any more details about what occurred at the Walmart, except to say that the investigating officers then tracked down the suspect to a house in Albuquerque.

When the officers arrived at the house, they attempted to “contain and observe” the suspect until backup could respond.

That’s when the man fled.

“A short vehicle pursuit ensued, during which the suspect rammed a Rio Rancho Police Department vehicle, and threatened officers with a firearm,” Vigil wrote in an email. “The response to that threat resulted in an officer involved shooting.”

The man died in the neighborhood southwest of Unser and Irving. Vigil said he had not been positively identified Tuesday afternoon. Complete article

How Walmart has affected Carpentersville Ill. crime, economy 08/28/2017

The new Walmart Supercenter in Carpentersville was bustling with activity from the moment it opened on a hazy Wednesday morning last summer.

The community welcomed the world's largest retailer to town with nothing short of a full-blown celebration, complete with balloon columns lining the aisles and cheerleaders greeting eager customers at the door.

The same day, village police were called to the store at 7:31 p.m. when a security officer caught a juvenile boy trying to steal a cellphone charger. Officers would respond to four more retail thefts there within its first week.

Carpentersville officials say the long-awaited Walmart has lived up to the hype since its grand opening June 22, 2016. The $30 million store at 365 Lake Marian Road already has exceeded sales tax revenue projections and spurred business development on the village's east side.

But records show that economic success is juxtaposed with hundreds of calls for service -- and a stark increase in shoplifting cases -- handled by Carpentersville police at the store over the past year. Complete article

Shoplifters prosecuted as burglars? Tennessee appellate court says no 08/28/2017

A state appellate court has thrown a monkey wrench into a controversial policy driven by one of America’s largest retailers and launched in Knox County that labeled shoplifters as burglars and put them in prison – for stealing something as inexpensive as a toothbrush.

Tennessee Criminal Court of Appeals Judge Camille R. McMullen pulled no punches in explaining why she and two of her appellate brethren believe a policy that was being expanded across the state is unconstitutional.

It was, she said, a perversion of what legislators intended to do when crafting the law on burglary – punish people for breaking into houses or locked businesses.

Shoplifters, even repeat offenders, aren’t burglars, she wrote, and treating them as such violates the state and federal constitutions.

“Our review of the legislative history of the burglary statute shows that charging of burglary in these instances is unreasonable, unjust, and violative of due process,” McMullen wrote. Complete article

Back to school brawl leads to woman pulling gun at Novi Mich. Walmart 08/29/2017

NOVI, Mich. (WJBK) - Shoppers at a Walmart in Novi, Mich. were in for some frightening moments as they witnessed a woman pull out a loaded gun Monday afternoon. Police say the gun was pulled out during a fight over school supplies.

"It was in the back to school section over a notebook," says Novi Police Det. Scott Baetens.

Novi officers say two Farmington Hills women, ages 32 and 46, were inside the Novi Towne Center Walmart, shopping for school supplies. Apparently, so was a 20-year-old South Lyon woman and her mother, 51.

"One girl was going to buy a notebook. There was one left, some pushing resulted," Baetens says. "They began to argue who was the rightful purchaser of that notebook."

Both duos of women were not backing down, as police and witnesses described the two women pulling the younger woman's hair. That mother got shoved out of the way as the three continued to fight. That mother then pulled out a gun.

"She's a valid CPL holder," Baetens says. "She pulled out her firearm and tells them to stop attacking her daughter while pointing the gun at them." Complete article

EEOC Finds Evidence of Job Discrimination by Walmart Against NC Trans Woman 08/29/2017

New York, NY - Transgender Legal Defense & Education Fund has secured a victory before the United States Equal Employment Opportunity Commission ( "EEOC" ) on behalf of a transgender woman who endured employment discrimination at a Sam's Club store in Kannapolis, North Carolina. Sam's Club is a membership-only retail warehouse chain and a subsidiary of Walmart. The EEOC found evidence that Charlene Bost faced discrimination and a retaliatory hostile work environment in her position as a cashier supervisor from 2013 through her firing in 2015. This discrimination violated Title VII of the Civil Rights Act of 1964.

"Sam's Club wasn't safe for me as a transgender woman," said Ms. Bost. "No one should be treated the way I was while just trying to do my job. I care about doing good work, but my efforts were met with bias, hostility and retaliation from coworkers and supervisors who targeted me for being transgender. I brought this case because trans people have a right to be treated fairly. Sam's Club must be held accountable."

After Ms. Bost transitioned, co-workers and supervisors began discriminating against her for being transgender. She was repeatedly subjected to a barrage of hostilities on the job which included being wrongfully disciplined and repeatedly misgendered. The EEOC Letters of Determination are available at the link: transgenderlegal.org/media/uploads/doc_729.pdf . Complete article
